I. General Provisions

1. Section "Qualification characteristics of the positions of workers engaged in activities in the field of civil defense, protection of the population and territories from natural and man-made emergencies, ensuring fire safety, safety of people at water bodies and mining facilities in underground conditions" qualification handbook positions of managers, specialists and employees (hereinafter referred to as the section) is intended to address issues related to the regulation of labor relations and ensuring an effective management system for employees carrying out activities in the field of civil defense, protecting the population and territories from natural and man-made emergencies, ensuring fire safety , safety of people at water bodies and mining facilities in underground conditions.

2. The section contains the qualification characteristics of the positions of employees of emergency rescue and search and rescue teams, civil defense, subdivisions of the State Inspection for Small Vessels, paramilitary mine rescue units (hereinafter referred to as employees of the EMERCOM of Russia).

3. The qualification characteristics included in the section (hereinafter referred to as the qualification characteristics) are intended to substantiate the rational division and organization of labor, the correct selection, placement and use of personnel, to ensure unity in defining the job duties of EMERCOM of Russia employees and the requirements for them. qualification requirements.

4. Qualification characteristics are used as normative documents of direct action or serve as the basis for the development of job descriptions containing a specific list of job duties of employees of the EMERCOM of Russia, taking into account the specifics of the organization of production, labor and management. If necessary job dutiesincluded in the qualification characteristics of a certain position can be distributed among several performers.

When developing job descriptions, it is allowed to clarify the list of jobs that are characteristic of the corresponding position in specific organizational and technical conditions, and the requirements for special training of employees.

In order to improve the organization and increase the efficiency of work of EMERCOM employees of Russia, it is possible to expand the range of their duties in comparison with the established corresponding qualification characteristics. In these cases, without changing the official name, the employee may be entrusted with the fulfillment of duties provided for by the qualification characteristics of other positions that are similar in the content of work, equal in complexity, the performance of which does not require another specialty and qualification.

5. The qualification characteristics of each position contains three sections: "Job responsibilities", "Must know" and "Qualification requirements".

The section "Job responsibilities" establishes the main labor functions that can be entrusted in whole or in part to an employee holding this position, taking into account the technological homogeneity and interconnectedness of work, allowing for optimal specialization of employees.

The section "Should know" contains the basic requirements for an employee in relation to special knowledge, as well as knowledge of laws and regulations, regulations, instructions and other guidance documents, methods and means that the employee must apply in the performance of job duties.

The section "Requirements for qualifications" defines the level of professional training of an employee required to perform the specified job duties, and requirements for work experience.

6. For certain positions of employees of the EMERCOM of Russia, on the basis of the decision of the qualification (certification) commission, qualification classes are assigned.

7. The qualification characteristics provide for within the same position, without changing its name, intra-job qualification categorization.

The categories of qualifications of positions of employees of the EMERCOM of Russia, contained in the section, are established by the head of the relevant institution, taking into account the complexity of the work performed or professional excellence, the degree of independence and responsibility of the employee in the performance of official duties, attitude to work, efficiency and quality of work.

8. The section does not include the qualifications of the positions of deputy managers. The job responsibilities of these workers, the requirements for their knowledge and qualifications are determined on the basis of the characteristics of the managers of the corresponding basic positions.

9. Persons who do not have special training or work experience established in the section "Requirements for qualifications", but who have sufficient practical experience and perform the job duties assigned to them with high quality and in full, on the recommendation of the certification commission, are appointed to the corresponding positions in the same way, as well as persons with special training and work experience.

II. Qualification characteristics of employee positions

Diving specialist (central airmobile

Job responsibilities. Heads and organizes the work of the diving service in everyday conditions and conditions of occurrence and elimination of emergency situations in the water areas. Cooperates within its competence with other units of the central airmobile rescue squad, regional search and rescue squad, search and rescue squad, agile search group, rescue station, participating in the activities of the diving service, to solve the tasks assigned to this service. Organizes the work of the diving qualification commission. Participates in the work of the diving medical commission. Carries out control over the recruitment of diving regular or non-standard subdivisions (stations) with diving and auxiliary personnel, diving equipment and property. Head of the search and rescue unit

Job responsibilities. Supervises the activities of the search and rescue unit, coordinates the activities of search and rescue groups in readiness mode and activities in emergency situations. Participates in the development of situational tasks and plans for carrying out rescue operations, in the physical, technical and special training of persons involved in rescue operations. Supervises emergency rescue operations. Carries out work to improve the technologies and methods of carrying out rescue operations, the use of rescue tools and other rescue equipment in the performance of rescue operations, as well as the introduction of modern, safe methods of work, search and detection of victims. Organizes planning, accounting and reporting on rescue operations. Ensures the technically correct operation of the equipment used, the rational conduct of rescue operations. Coordinates the work of search and rescue teams. Carries out the selection of personnel of rescuers and commanders of search and rescue groups and their placement. Assesses the situation at the site (facility) of the rescue operations. Informs the rescuers about the emergency in order to organize work to eliminate it. Job responsibilities. Supervises the activities of a maneuverable search group, diving operations and descents. Carries out measures to ensure the safety of life of people on water bodies. Participates in flood control measures. Conducts explanatory work among the population on the prevention of accidents on the water. Monitors compliance by the group's divers and persons providing diving descents with the rules on labor protection during diving operations, the correct operation of vehicles, watercraft, equipment and diving equipment, the frequency of inspection of pressure vessels. Checks diving equipment. Maintains diving documentation. Ensures the material and technical supply of the group, the safety of equipment and property.

Conducts explanatory work among the population on the prevention of accidents on the water. Job responsibilities. Manages the activities of the search and rescue service, coordinates the activities of the search and rescue service in readiness mode and activities in emergency situations. Job responsibilities. Participates in the development, organization and implementation of activities to provide psychological assistance to various categories, social and age groups of the population. Rescuer

Job responsibilities. Performs rescue, search and rescue and other urgent work in various climatic conditions using the appropriate equipment. Maintains constant readiness to participate in emergency response operations. Searches for victims, incl. with the use of special search devices, takes measures to rescue them, provides them with first aid and other types of assistance. He is on duty as part of the duty shift of the search and rescue squad. Explains the rules to citizens safe behavior in order to prevent emergencies and the procedure in case of their occurrence. New specialties and old mistakes

So, what changes were made by the Ministry of Health to the aforementioned decree? First of all, it is necessary to note the appearance of six new specialties in the Qualification Requirements: "Medicine"; "Medical and preventive work"; "Medical Biochemistry"; "Medical Biophysics"; "Medical Cybernetics"; "Nursing"; "Pharmacy". Undoubtedly, the inclusion of these specialties in Order No. 707n can be welcomed, since this achieves at least partial compliance of the medical and pharmaceutical specialties of higher education with the order of the Ministry of Education and Science of Russia dated 12.09.2013 No. 1061 "On approval of the lists of specialties and areas of training for higher education" and the order of the Ministry of Health of Russia from 07.10.2015 No. 700n "On the nomenclature of specialties of specialists with higher medical and pharmaceutical education." In addition, order No. 328n eliminated a number of discrepancies between the order of the Ministry of Education and Science of Russia No. 1061 and the order of the Ministry of Health of Russia No. 707n. Recall that according to the order of the Ministry of Education and Science of Russia dated 12.09.2013 No. 1061 "On the approval of the lists of specialties and areas of training for higher education" there are two qualifications of the same name "pediatrician". Thus, the qualification "pediatrician" is awarded in case of obtaining higher education in the form of a specialist in the specialty 05/31/02 "Pediatrics". But at the same time, the qualification "pediatrician" is also awarded after training highly qualified personnel in residency programs in the specialty 08/31/19 "Pediatrics". Thus, an unacceptable situation has developed when one term denotes two completely different qualifications corresponding to two different specialties and different levels of training.

The new order No. 328n amended the qualification requirements for medical and pharmaceutical workers with higher education, adding to it specialties that do not require postgraduate education in the form of residency / internship. At the same time, in relation to pediatricians, he did not add a new specialty (which can hardly be considered correct), but added a note to the text of the order according to which “for persons who received education in the basic educational program in accordance with the federal state educational standard of higher education in the specialty 05/31/02 Pediatrics (specialist level) after January 1, 2016 and accredited specialists, training in internship / residency is not mandatory when filling the posts of a district pediatrician. " This change brings the order of the Ministry of Health of Russia No. 707n in accordance with the order of the Ministry of Education and Science of Russia No. 1061 dated 12.09.2013. However, in our opinion, the changes made are insufficient. Although they provide an opportunity for young graduates of medical universities without postgraduate education to work as a district pediatrician, the very name of the position proposed in Order No. 328n is unfortunate, since it coincides with the name of the position in which pediatricians who have completed their residency work. We believe what is an unfortunate job title may violate the patient's right to, when choosing a doctor, information about doctors, about their level of education and qualifications. In this case, the patient will not be able to understand who the position of "district pediatrician" means - a doctor without postgraduate education or a doctor who has already completed his residency. And doctors who have received postgraduate education should be justly offended by this state of affairs.

With regard to other newly introduced specialties, Order No. 328n, apparently, nevertheless decided to focus on the recently adopted professional standards and repeated a number of mistakes contained in these standards. So, repeated mistakes made in the relevant professional standards: wrong the name of the position of graduate dentists without postgraduate education as "dentist" (in our opinion, such a position should be provided only to doctors who have completed their residency) instead of “general practitioner dentist”; the opportunity to occupy the same position of "pharmacist-technologist" both for pharmacists who have just graduated from a university without postgraduate education, and for pharmacists who have completed their residency / internship; the opportunity to occupy the same position as a "district therapist" for doctors with completely different qualifications (specialist in "general medicine", residency in "therapy", residency in "general practice (family medicine)"). As for the positions that graduates of the specialty "Medical and Preventive Business" can occupy, then the norms of Order No. 328n contradict even the relatively recently approved corresponding professional standard (Order of the Ministry of Labor of Russia dated June 25, 2015 No. 399n). So, according to the specified professional standard, a specialist in the field of medical and preventive business, who graduated from the specialty can work in 18 different positions. At the same time, according to the order of the Ministry of Health of Russia No. 328n, only 2 positions are provided - "general hygiene doctor" and "epidemiologist". The Faculty of Medical Law supports the reduction of the number of positions provided for specialists in the field of medical and preventive affairs (and believes that changes aimed at reducing the number of possible positions should be made to the professional standard), but cannot agree with the positions selected in Order No. 328n. First, the federal state educational standard of higher education in the specialty 32.05.01 Preventive medicine, approved by the Order of the Ministry of Education and Science of the Russian Federation of 16.01.2017 No. 21 does not limit the range of professional tasks of a specialistwho has completed the appropriate training, exclusively hygiene and epidemiology... Secondly, the position of "general hygiene doctor" is also provided for graduates of the internship / residency in the specialty "general hygiene", and the "doctor epidemiologist" is for graduates of the internship / residency in the specialty "epidemiology", which may lead to work for some and the same positions (with the same labor and / or official duties) doctors of various qualifications. Obviously, the authors of the order wanted to bring the terminology closer to the order of the Ministry of Education and Science of Russia No. 1061, but did not take into account that they were being assigned a qualification, not a position. It should be noted that the Faculty of Medical Law has always considered it necessary to combine reasonable criticism of certain provisions of regulatory legal acts with constructive proposals for their improvement. In this case, it seems to us the most rational to provide a unified title of the position for graduates in the specialty "preventive medicine" - a doctor in medical prevention. Such a position is present in the Nomenclature of positions medical professionals and pharmaceutical workers, approved by order of the Ministry of Health of Russia dated December 20, 2012 No. 1183n, but so far it has not been mentioned either in the original text of the order of the Ministry of Health of Russia No. 707n or in the changes introduced by order No. 328n

Also unsuccessful should be recognized the titles of positions for graduates of the specialty in the specialties "Medical Biochemistry" proposed in Order No. 328n; "Medical Biophysics"; "Medical Cybernetics" (professional standards for these specialties have not yet been approved).

So, for example, for a graduate of medical cybernetics, the position of "doctor-statistician" is offered. However, the same position is provided for 2 (!) Specialties, providing for the completion of the residency: "Organization of health care and public health", "Social hygiene and organization of the state sanitary and epidemiological service." In addition to all others, those who have completed an internship in the specialty "Nursing Management" can apply for the position of a statistician. The title of the position - "doctor-statistician" is also quite controversial. After all, the professional tasks for the solution of which the training in the specialty "Medical Cybernetics" is oriented are not limited to medical statistics. According to the federal state educational standard of higher education in the specialty 05/30/03 Medical cybernetics (specialist level), approved by Order of the Ministry of Education and Science of Russia No. 1168 dated 09/12/2016, a graduate who has mastered the program must be ready to solve such professional tasks as: diagnostics of diseases and pathological conditions of patients ; carrying out measures for hygienic education and disease prevention among the population; analysis, creation, implementation and operation of medical information systems and communication technologies; compliance with the basic requirements of information security for the development of new methods and technologies in the field of health care and much more. We note that these professional tasks are not directly related to medical statistics - and all the more strange is the title of the position for such a specialist.

As for the graduates of "Medical Biochemistry" and "Medical Biophysics", the names of their positions also coincide with the names of the positions of specialists who have completed their residency: accordingly, a doctor of clinical laboratory diagnostics can be both a newly graduated specialty in medical biochemistry and those who have already completed their residency. on "clinical laboratory diagnostics"; a functional diagnostics doctor can be either a newly graduated specialist in medical biophysics or a person who has already completed his residency in “functional diagnostics”.

Given the tendency to duplicate errors in the Qualification Requirements and professional standards, we have every reason to fear that the future professional standards of specialists in medical cybernetics, medical biochemistry and medical biophysics will inherit all the mistakes made in the preparation of the order of the Ministry of Health of Russia No. 328n.

Eligibility requirements and ... gender discrimination

However, Order No. 328n in relation to new specialties has its own mistakes and inaccuracies that have nothing to do with professional standards. The most striking example is the names of the positions of graduates in the specialty "nursing" (provides for the completion of a bachelor's degree). According to order No. 328n, this specialty provides for work in the following positions: “ nurse general practice ”,“ palliative care nurse ”,“ prevention nurse ”,“ rehabilitation nurse ”. From the names of these positions it becomes clear that the Ministry of Health wanted to correlate the duties of nurses and the types of medical care enshrined in the Federal Law of November 21, 2011 No. 323-FZ "On the Fundamentals of Health Protection of Citizens in the Russian Federation." However, they have nothing to do with the terminology of secondary positions. medical staff, enshrined in the legislation. So, for example, the order of the Ministry of Education and Science of Russia No. 1061 provides for those trained in the direction of "nursing" to obtain the qualification "academic nurse". Of course, one can argue that qualifications and position are not the same (although among medical workers, their names often coincide). In the nomenclature of positions of medical workers and pharmaceutical workers approved by the order of the Ministry of Health of Russia dated December 20, 2012 No. 1183n, there are 22 positions nurses... However, neither the “general practice nurse” nor the “palliative care nurse” nor the “prevention nurse” is mentioned in it. It should be admitted that nomenclature still contains the position of "rehabilitation nurse", but refers her to the positions of specialists with secondary vocational (medical) education, which contradicts Order No. 328n. Finally, the section "Qualification characteristics of positions of workers in the health sector" of the Unified qualification reference book of positions of managers, specialists and employees, approved by order of the Ministry of Health and Social Development of the Russian Federation of July 23, 2010 No. 541n also, firstly, includes all nursing positions (with the exception of the chief nurse ) to the posts of middle and junior medical personnel, and secondly, in general does not contain the positions mentioned in order No. 328n.

In addition, you should pay attention to the fact that the authors of the order did not foresee the situation when the specialty "nursing" is received by a man... In the order of the Ministry of Education and Science of Russia No. 1061, it was stipulated that in this case, for males, the name of the qualification sounds like "academic medical brother." As for the recent order of the Ministry of Health of Russia No. 328n, then, given the proposed job titles, either it is generally assumed that men will not be hired for such positions (which is a serious gender discrimination), or it is proposed to call male health workers in these positions “nurses” (which, taking into account domestic cultural and linguistic peculiarities, it can also be considered as ridicule and discrimination).

Of course, the inclusion in the Qualification Requirements for Medical and Pharmaceutical Workers with higher education in the direction of training "Healthcare and Medical Sciences" of the requirements for specialists who have graduated from a bachelor's degree is correct. After all, higher medical (pharmaceutical) education is not limited to specialty and residency. However, in the order of the Ministry of Health of Russia No. 328n, the magistracy was completely ignored... According to the order of the Ministry of Education and Science of Russia No. 1061, there is a magistracy in the specialties 32.04.01 "Public health", and 32.04.01 "Industrial pharmacy". According to part 5 of article 10 Federal law dated December 29, 2012 No. 273-FZ "On Education in the Russian Federation", Master's degree refers to higher education. Thus, the qualification requirements for medical and pharmaceutical workers with higher education in the direction of training "Healthcare and Medical Sciences" should logically include the requirements for medical and pharmaceutical workers who have graduated from the magistracy.

Osteopathy - no right to work

The situation is even worse with osteopathy (there is currently no professional standard for this specialty). The new order No. 328n expanded the list of specialties of higher education, which opens access to work in the specialty "osteopathy". Now, the specialty in "General Medicine" and "Pediatrics" has been supplemented with a specialty in "Dentistry" (although the idea of \u200b\u200bretraining a dentist as an osteopath still raises a number of doubts - if such an osteopath deals exclusively with osteopathy of the maxillofacial apparatus, it would be more reasonable to allocate a separate specialization for this , if osteopathy will be applied in full, it is not clear whether the amount of knowledge gained at the Faculty of Dentistry will be sufficient). However, the main drawback of Order No. 328n regarding osteopathy is that they simply forgot that since 10.04.2017 in the order of the Ministry of Education and Science No. 1061, a specialty in osteopathy is provided (specialty 31.05.04). Thus, a paradoxical situation has been created: according to the order of the Ministry of Health No. 707, taking into account the changes introduced by order No. 328n., a graduate who has completed a specialty in osteopathy has no right to work in the specialty (both order No. 707n and order No. 1061 imply the obligatory end of the residency in osteopathy) no right to enroll in osteopathy residency (according to the order №328n residency in osteopathy is intended for specialists in "general medicine", "pediatrics" and even "dentistry", but is not intended for those with a diploma in "osteopathy").

Changes in retraining

The list of specialties in which dentists could undergo retraining has undergone significant changes. So now, according to the order of the Ministry of Health of Russia No. 328n, dentists will not be able to change their specialty to such specialties as Physical Therapy and Sports Medicine, Manual Therapy, Radiology, Physiotherapy, and Functional Diagnostics. The decision to limit the possibilities of retraining for dentists looks, in our opinion, at least not justified. And if these steps can still be understood in relation to sports medicine (although even in this case dentists cannot be called laymen - occupational diseases (especially injuries) of athletes often touch the teeth or jaws and are within the competence of the dentist), why was it decided to prohibit the possibility of retraining a dentist as a radiologist?

The introduction of such changes, in our opinion, does not allow us to exclude adverse consequences related to trust in the objectives of the order. Indeed, some representatives of the medical and paramedical community may well take such ill-conceived "innovations" as the result of lobbying activities of professional communities (in the given example - radiologists), striving to monopolize the possibility of obtaining the specialty "radiology" (and, consequently, the market of services in the field of X-ray diagnostics) and discriminating against doctors of other specialties, depriving them of the opportunity to undergo retraining as a radiologist. We are very much afraid that the assumptions about the possibility of lobbying activities in the Ministry of Health of Russia may significantly hit both the authority of some professional circles that allow unscrupulous competition and violate the foundations of medical ethics, and the authority of the Ministry of Health of Russia itself (which, in our opinion, must be avoided at any cost - for example, the recognition of the unreasonableness of the introduced prohibitions on the retraining of dentists and their cancellation).

First, it is not clear why, according to the authors of Order No. 328n, the specialty of a dentist is closer to an osteopath than to a radiologist? After all, the dentist meets daily with different kinds X-ray images of the dentoalveolar apparatus, on their basis, he makes a diagnosis, carry out calculations, and develops treatment tactics. The dentist is not directly related to osteopathic procedures, osteopathic techniques and techniques are not used in dentistry. Nevertheless, the authors of the order of the Ministry of Health No. 328n for some reason considered that a certified dentist would be able to master the profession of an osteopath, but would not be able to master the specialty of a radiologist.

Secondly, the order of the Ministry of Health No. 328n left the possibility of retraining in radiology for medical workers with specializations "Medical Biophysics" and "Medical Cybernetics". It is quite an ordinary situation when a biophysicist or a cybernetic doctor performs work that is completely unrelated to X-ray studies, but, nevertheless, an order has been given to them to change their specialization to a radiologist.

But the field of opportunities for obtaining the specialty "reflexology" was significantly expanded. Order of the Ministry of Health of Russia No. 328n allowed doctors trained in residency / internship in such specialties as "Infectious Diseases", "Psychiatry", "Psychiatry-Narcology" to change their profession to "reflexology". The Faculty of Medical Law supports such changes, since at present reflexology is widely used for minor mental illnesses (including depression), as an integral part of general strengthening treatment for infectious diseases, and is also used in the fight against nicotine addiction.

CMO is not for everyone?

You should also welcome the appearance in the order of the Ministry of Health of Russia No. 328n of references to continuous medical education (CME) provided for in Part 2 of Article 82 of the Federal Law of December 29, 2012 No. 273-FZ "On Education in the Russian Federation". The mention of continuous improvement of qualifications during the entire work activity occurs in relation to 9 specialties that provide for work after graduation from a university without postgraduate education (residency): "Treatment"; "Medical and preventive work"; "Medical Biochemistry"; "Medical Biophysics"; "Medical Cybernetics"; "Pediatrics"; "Nursing"; General Dentistry; "Pharmacy". At the same time, for specialties that provide for education in residency, the requirements for advanced training are formulated as “advanced training at least once every 5 years during the entire labor activity” ( the word "continuous" is no longer used). In our opinion, such a difference in wording creates the illusion that after the end of the residency, the requirements for continuing medical education are softened, which is contrary to the spirit and letter of the Federal Law "On Education in the Russian Federation", which presupposes continuous medical education; continuous improvement of professional knowledge and skills throughout life as well as continuous professional development and expansion of qualifications for all medical and pharmaceutical workers.

Other changes

Of the other changes introduced by Order of the Ministry of Health of Russia No. 328n, it should be noted that the terminology was brought in line with the legislation. So, for example, the rather vague phrase "basic specialties or specialty requiring additional training" (which specialty can be considered the main one?) Was replaced by "enlarged groups of specialties" Clinical medicine"Or" Health Sciences and Preventive Medicine. " The mentioned groups of specialties are contained in the order of the Ministry of Education and Science of Russia No. 1061 and represent a clear closed list that excludes the possibility of ambiguous interpretations.

In addition, the order of the Ministry of Health of Russia No. 328n introduced a number of technical changesaimed at correcting inconsistencies that arose during the reform of medical education and the abandonment of internship. Thus, references to internship as one of the levels of professional education were removed from those specialties where interns were not graduated in practice ("Nephrology"), the norm was removed, suggesting the passage of residency in the specialty "Cosmetology" (previously cosmetologists could receive their specialty either by passing a residency in cosmetology or through a residency in Dermatovenereology and retraining in Cosmetology; nevertheless, in practice, the vast majority of cosmetologists received their specialty in the second way, since those who completed their residency in cosmetology had no opportunity to change their qualifications in the future; in addition, due to the lack of cosmetology hospitals and the difficulties of organizing residency, the educational institutions themselves preferred to organize advanced training courses for dermatovenerologists instead of specialized residency in cosmetology); the opportunity was added to work in the specialty "Pediatrics" not only for those doctors who have undergone retraining in the relevant specialty in the residency, but also in the internship (since 2016, the internship in Russia does not exist, but the doctor could undergo retraining until 2016), etc. etc.

Thus, the order of the Ministry of Health of Russia No. 328n is ambiguous. On the one hand, it introduces the necessary and long overdue changes to the Qualification Requirements for medical and pharmaceutical workers with higher education in the field of training "Healthcare and Medical Sciences", approved by order of the Ministry of Health of the Russian Federation of October 8, 2015 No. the opportunity to work immediately after graduating from a specialty; streamlining changes related to advanced training in residency / internship; bringing terminology in line with other legislative acts, etc.). On the other hand, the scope of the changes made is clearly insufficient, many significant conflicts with other regulatory legal acts (for example, with the order of the Ministry of Education and Science No. 1061) have remained and require urgent introduction of additional changes to the Qualification Requirements (an example is the situation with an osteopath, when the norms of the Qualification Requirements approved by the order of the Ministry of Health of Russia No. 707 completely contradict the order of the Ministry of Education and Science of Russia No. 1061 and call into question for graduates of medical universities in the specialty "osteopathy" both the right to work after graduation, and the right to continue their studies and enroll in residency in "osteopathy").

Moreover, a very negative trend is the consolidation in the qualification requirements of mistakes made in the preparation of professional standards of a number medical specialties ("Pediatrician", "general practitioner (general practitioner) district", "dentist", "pharmacist"). Instead of a critical analysis of these professional standards, the authors of the order of the Ministry of Health of Russia No. 328n simply mechanically transferred their norms to the Qualification Requirements, which is why the same mistake (for example, the same job title for doctors with different specialties and qualifications) will now have to be corrected in two regulatory legal acts : both in the professional standard and in the Qualification requirements.

Some norms of Order No. 328n formally have no shortcomings from the legal side, however, they are in conflict with practical activities doctors, do not take into account its specifics (for example, they do not take into account the fact that dentists, when carrying out medical practice, work much more often with the results of X-ray studies than statisticians (specialty "medical cybernetics"), etc.).

The disadvantages of the Qualification Requirements and their inconsistency with other acts in the field of education, health care and labor activity are aggravated by the unresolved issue of the mandatory compliance with the Qualification Requirements. Currently, in accordance with Articles 57, 195.2 and 195.3 Labor Code RF, only qualification requirements enshrined in a professional standard or a single qualification reference book are mandatory. The qualification requirements approved by order of the Ministry of Health of Russia No. 707n and supplemented by order No. 328n are not a professional standard or part of a unified qualification reference book and, therefore, federal laws do not establish their binding. Moreover, as we indicated above, a number of norms of the order of the Ministry of Health of Russia No. 707n (taking into account the changes introduced by order No. 328n) contradict a number of norms of the Unified Qualification Handbook of the Positions of Managers, Specialists and Employees, approved by order of the Ministry of Health and Social Development of the Russian Federation of July 23, 2010 No. 541n , as well as some norms of the corresponding professional standards... Thus, in cases of collisions with the listed normative acts, the norms of the order of the Ministry of Health of Russia No. 707n cannot be guided by. This factor undermines confidence in the Qualification Requirements approved by Order of the Ministry of Health of Russia No. 707n and provokes ignorance of these requirements.

Considering the above, it can be stated that despite a number of positive changes introduced by order of the Ministry of Health of Russia No. 328n, the qualification requirements approved by order of the Ministry of Health of Russia No. 707n of October 8, 2015 are still far from perfect. Their correction is possible by preparing another, this time much more complex, draft amendments to the Qualification Requirements. But, it is worth noting that, in our opinion, the preparation of such changes should be considered by the Ministry of Health of Russia not as the elimination of technical errors (namely, this was stated by the Ministry of Health in the Explanatory Note to the draft order No. 328n as the goal of the draft act), but as one of the key components of improving the system of training medical and pharmaceutical specialists in the Russian Federation.

1. Clause 8 shall be stated as follows:

"8. Accreditation commissions are formed by the Ministry of Health of the Russian Federation with the participation of professional non-profit organizationsspecified in Article 76 of Federal Law No. 323-F3.

In the constituent entity of the Russian Federation, accreditation commissions are formed to conduct the accreditation of specialists who have:

  • higher medical education (specialty, residency, bachelor's, master's);
  • higher pharmaceutical education (specialty, residency) or secondary pharmaceutical education;
  • secondary medical education;
  • other higher education. "

2. Clause 12 shall be amended as follows:

"12. The persons specified in clauses 10 and 10.1 of these Regulations, with the exception of the chairman of the commission, must have:

  • higher or secondary vocational education in the specialty specified in the nomenclature of specialties for specialists with higher medical and pharmaceutical education, or in the Nomenclature of specialties for specialists with secondary medical and pharmaceutical education in the healthcare sector of the Russian Federation;
  • a valid certificate of a specialist or a certificate of accreditation of a specialist and work experience of at least 5 years. "

3. Clause 13 shall be amended as follows:

"thirteen. The composition of the accreditation commissions specified in clause 8 of these Regulations is approved by the order of the Ministry of Health of the Russian Federation annually. "

a) supplement with a new paragraph six of the following content: "forms accreditation subcommittees;";

5. Clause 16 shall be amended as follows:

"16. Deputy Chairman of the Accreditation Commission:

  • acts as the chairman of the accreditation commission in his absence;
  • ensures the interaction of the chairman of the accreditation commission with the accreditation subcommittees;
  • performs other functions on behalf of the chairman of the accreditation commission. ”.

a) the second paragraph shall be stated in the following edition:

"Registers the copies of the minutes of the meetings of the accreditation subcommissions received from the accreditation subcommittees;";

b) the third paragraph shall be declared invalid.

7. Supplement with clauses 18.1-18.6 as follows:

"18.1. The chairman of the accreditation commission, from the members of the accreditation commission, forms accreditation subcommittees for the specialties for which the accreditation of specialists is carried out (hereinafter referred to as accreditation subcommittees).

18.2. The accreditation subcommittee consists of the chairman of the accreditation subcommittee, deputy chairman of the accreditation subcommittee, members of the accreditation subcommittee and the executive secretary of the accreditation subcommittee.

The composition of the accreditation subcommittee is approved by the minutes of the meeting of the accreditation commission.

18.3. Chairman of the accreditation subcommittee:

  • carries out general management of the activities of the accreditation subcommittee and organizes its activities;
  • presides over the meetings of the accreditation subcommittee; ensures that the members of the accreditation subcommittee comply with the procedure for conducting the accreditation of a specialist, established by these Regulations;
  • distributes responsibilities among the members of the accreditation subcommittee;
  • agrees with the chairman of the accreditation commission the rules of procedure of the accreditation subcommittee;
  • appoints the deputy chairman of the accreditation subcommittee and the executive secretary of the accreditation subcommittee.

18.4. The deputy chairman of the accreditation subcommittee acts as the chairman of the accreditation subcommittee in his absence, performs other functions on behalf of the chairman of the accreditation subcommittee.

18.5. Executive secretary of the accreditation subcommittee:

  • registers and considers documents submitted to the accreditation subcommittee by persons who have expressed a desire to undergo specialist accreditation;
  • provides the secretary of the accreditation commission with copies of the minutes of the meetings of the accreditation subcommittees;
  • notifies persons who have expressed a desire to undergo specialist accreditation of the timing of its conduct;
  • prepares materials for meetings of the accreditation subcommittee and draft decisions of the accreditation subcommittee;
  • keeps minutes of meetings of the accreditation subcommittee; ensures interaction with the accreditation commission;
  • provides the secretary of the accreditation commission with the materials necessary for the consideration of complaints accredited against the decisions of the accreditation subcommittee;
  • performs other functions in accordance with these Regulations and on behalf of the chairman of the accreditation subcommittee.

18.6. The work regulations of the accreditation subcommittee are determined by the chairman of the accreditation subcommittee and approved by the minutes of the meeting of the accreditation subcommittee. "

8. Clauses 19:22 shall be stated as follows:

"19. The main form of activity of the accreditation commission and the accreditation subcommittee is a meeting.
Based on the results of the meeting of the accreditation commission or the accreditation subcommittee, the minutes of the meeting of the accreditation commission or accreditation subcommittee are drawn up.

20. Minutes of meetings of the accreditation commission and the accreditation subcommittee are signed by all participants in the meeting immediately after its end.

In case of disagreement with the decision of the accreditation commission or the accreditation subcommittee, the meeting participant has the right to demand that a dissenting opinion be entered into the minutes or state it in writing in an application addressed to the chairman of the accreditation commission or the chairman of the accreditation subcommittee. The minutes of the meetings of the accreditation commissions are sewn into books and sent to the Ministry of Health of the Russian Federation, where they are kept in the archive for 6 years. The minutes of the meetings of the accreditation subcommittees are stitched into books and stored in the archives of educational and (or) scientific organizations for 6 years.

21. The meeting of the accreditation commission is held:

  • in order to approve the composition of the accreditation subcommittees;
  • in order to form an appeal commission;
  • based on the results of the accreditation of specialists;
  • in other cases provided for by these Regulations.

A meeting of the accreditation commission is competent if attended by at least half of the members of the accreditation commission.

22. The meeting of the accreditation subcommittee is held after each stage of the accreditation of the specialist specified in clause 33 of these Regulations, with the registration of the minutes of the meeting of the accreditation subcommittee (Appendix No. 1 to these Regulations).

The meeting of the accreditation subcommittee, held after each stage of the specialist's accreditation, is competent if all members of the accreditation subcommittee who participated in this stage took part in it. "

9. In paragraphs 23:25, the words "accreditation commission" in the appropriate case shall be replaced by the words "accreditation subcommittee" in the corresponding case.

10. In the fifth paragraph of clause 26 and the eighth paragraph of clause 27 the words "(if any)" shall be replaced with the words "(for foreign citizens and stateless persons - if any)".

11. In clauses 28, 29 and 31 the words "accreditation commission" in the appropriate case shall be replaced by the words "accreditation subcommittee" in the corresponding case.

12. Clause 32 shall be amended as follows:

"32. No later than 10 calendar days from the date of registration of documents, the accreditation subcommittee holds a meeting and makes a decision on the admission of the specialist accredited to accreditation and on the timing of the accreditation of the specialist (hereinafter - the decision of the accreditation subcommittee).

Information about the persons admitted to the accreditation of a specialist and the schedule of the accreditation of specialists is transferred by the accreditation subcommittee to the accreditation commission no later than 2 calendar days from the date of the decision by the accreditation subcommittee. "

13. In clauses 34, 37, 39, 40:43 and 45 the words "accreditation commission" in the corresponding case shall be replaced by the words "accreditation subcommittee" in the corresponding case.

14. Clause 46 shall be amended as follows:

"46. The assessment of the result of passing each stage of the accreditation of a specialist and the decision of the accreditation subcommittee on recognizing the accredited as having passed or not passed a separate stage of accreditation of a specialist are reflected in the minutes of the meeting of the accreditation subcommittee, signed on the day of completion of the stage of accreditation of a specialist, and are posted on the official website in the information and telecommunications network "Internet" and information stands of the organization specified in clause 7 of these Regulations, within 2 working days from the date of signing the protocol. ”.

15. Clause 47 shall be amended as follows:

"47. The meeting of the accreditation commission following the results of the accreditation of specialists is held within 2 working days from the date of posting on the official website in the information and telecommunication network "Internet" and information stands of the organization specified in clause 7 of these Regulations, the minutes of the meeting of the accreditation subcommittee following the results of the last stage of accreditation ...

The accreditation commission makes a decision on recognizing the accredited specialist as the accredited specialist or the specialist who has not passed the accreditation based on the results of consideration of the minutes of the accreditation subcommittee on the results of the specialist passing the accreditation stages.

The accredited person whose result of passing each stage of the specialist's accreditation is assessed as "passed" is recognized by the accreditation commission as having passed the specialist's accreditation.

The decision on recognizing the accredited specialist as having passed the accreditation is reflected in the final minutes of the meeting of the accreditation commission, signed on the day of the meeting of the accreditation commission, but no later than 2 working days from the date of posting on the official website in the information and telecommunication network "Internet" and information stands of the organization specified in clause 7 of these Regulations, minutes of the meeting of the accreditation subcommittee following the results of the last stage of accreditation.

The final protocol is sent by the executive secretary of the accreditation commission to the Ministry of Health of the Russian Federation within 5 calendar days from the date of signing. "

16. In clauses 48, 49, 50 and the second paragraph of clause 51, the words "accreditation commission" in the appropriate case shall be replaced by the words "accreditation subcommittee" in the corresponding case.

17. Clause 54 shall be amended as follows:

"54. An accredited person recognized by the accreditation commission as having not passed the accreditation of a specialist or recognized by the accreditation subcommittee as having not passed the stage of specialist accreditation has the right to file a complaint against the corresponding decision of the accreditation commission or accreditation subcommittee to the appeal commission within 2 working days from the date of placement in accordance with paragraph 46 of this Regulation of the results of passing accreditation stage. "

18. In clause 56, the words "accreditation commission" shall be replaced by the words "accreditation subcommittee".

19. Clause 58 shall be amended as follows:

"58. Based on the results of consideration of the complaint, the appeal commission makes a decision to satisfy the complaint and annul the decision of the accreditation commission or the accreditation subcommittee against which the complaint was submitted, or to refuse to satisfy the complaint and leave the decision of the accreditation commission or accreditation subcommittee unchanged. "

20. Clause 60 after the words “accreditation commission” shall be supplemented with the words “or accreditation subcommittee”.

21. Appendix No. 1 to the Regulations on the Accreditation of Specialists (hereinafter referred to as the Regulations):

a) the words "MINUTES OF THE ACCREDITATION COMMISSION" shall be replaced with the words "THE MINUTES OF THE ACCREDITATION SUBMISSION MEETING ON THE RESULTS OF THE ACCREDITATION STAGE OF SPECIALISTS";

For persons who have received education in the basic educational program in accordance with the federal state educational standard of higher education in the specialty 31.05.02 Pharmacy (specialist level) after January 1, 2016 and have passed the accreditation of a specialist.
