The main document for all gardeners - the law on gardening, horticulture and dacha farming - has changed its name today. It was decided to abandon the concept of “giving”. The deputies equated dacha plots with garden plots and left only 2 forms of citizens' associations: horticultural or horticultural partnership. It is possible to build residential and garden houses on garden plots, it is allowed to register in them. Experts say that thanks to this, the townspeople will begin to move en masse to their dachas.

The concept of “garden house” has changed - now it is proposed to consider the building of “seasonal use” as such. Gardeners will have to be content with utility rooms for inventory and harvest. If there is already a cottage in the garden, you will not have to demolish it. But they won't be allowed to build a new one either.

Another innovation will protect those gardeners who have not yet completed their land plots or homes. The original version deprived them of membership in the partnership, said Nikolai Nikolayev, head of the State Duma Committee on Property and Land Relations. Now, in order to participate in the life of SNT, it is enough to have a gardener's book or a payment document membership fees... Also, summer residents who do not want to throw off for general needs will still be obliged to do this.

NIKOLAEV: Those people who are not owners of land plots and, in principle, cannot be them, we have equated in rights to the owners of plots. We also solved a huge problem: about a third of citizens who are gardeners do not want to participate in the activities of such associations. And we have clearly defined the relationship between such people and non-profit associations of gardeners.

Local authorities will be allowed to help horticultural associations, which, after the adoption of the law, will become full-fledged villages. In particular, municipalities can take over the maintenance of access roads and power lines to SNT, says deputy Nikolaev.

NIKOLAEV: Many asked questions about power grids and other engineering communications. Municipalities applied - they wanted to support horticultural associations on their territory, but could not do it. We have written in the bill, now there is a norm on the transfer of networks to the balance of municipalities with their consent.

All SNT will be obliged to obtain a license for water wells. This will make it easier and cheaper for gardeners to get a permit. From the list required documents removed the expertise and projects that only specialized companies could do.

The entry into force of the law on gardening was postponed to the beginning of 2019. In addition, another 5 years were taken to reorganize dacha partnerships and cooperatives into garden partnerships. So 60 million summer residents have time to put in order the documents for their 6 acres.

Prime Minister Dmitry Medvedev proposed an amnesty for summer residents, who had drilled water wells before 2006. For them, well licenses are planned to be renewed automatically and free of charge.

Summer residents near Moscow complained to the Prime Minister about the dominance of "controllers" demanding money for the renewal of the license allowing the operation of water wells.

Larisa Grigorieva, an accountant of the Khimfarm SNT near Moscow, during a meeting with Medvedev said that "horticultural associations are beginning to conduct environmental checks on the use of wells for water production." "We are talking about a license for wells. Penalties for individuals set at 3-5 thousand rubles, for partnerships - up to 1 million rubles ", - she explained.

"Obtaining a license is not only an expensive process, but also a rather lengthy process. Are such inspections and fines legal? Is there a deadline set by federal legislation for obtaining a license for wells?" - the summer residents asked a question to Medvedev.

In 2006, a new "Water Code of the Russian Federation" was adopted, among the provisions of which there was a requirement for compulsory licensing of drilling a water well (well).

But until 2015, there was no strict control over the implementation of the law, which led to the emergence of "intermediaries" selling licenses, and in 2016, checks began on the legality of ownership of water wells.

Summer residents near Moscow complained first.

Medvedev called the licensing requirements for wells legal: "There is no doubt about the law, it was specially adopted in order to streamline the use of water."

But the implementation of the law is not always accurate, there are "some organizations" that are already beginning to collect "fines", "fees" in order to quickly issue a license.

"Water is a value, you really need to control what happens to it. But the fact that some organizations ask for money in order to obtain such a license from the established authorized government bodies, Is a complete disgrace. These licenses were not introduced for intermediaries to make money on them, "Medvedev said.

The head of government proposes to amnesty the owners of water wells who drilled them before 2006. Permits for them will be renewed automatically and free of charge.

Medvedev has already instructed to work out such an amendment to the law.

“Actually, I have already instructed my colleagues in the government and governors to work it out, this applies to all regions,” the prime minister noted. “If we are talking about the water use of an ordinary member of a horticultural partnership in the range of up to 100 cubic meters of water, this does not require licensing. These are quite decent figures. that allow a specific person to use water without excessive bureaucracy. "

As for large water consumers - horticultural associations, then their licenses will be renewed for free.

"It seems to me that it would be right. And whoever applies again, new partnerships, let them receive a license in accordance with the established procedure. I think it will be fair. And we will definitely bring this idea to life," Medvedev assured.

“The fact is that many of our strong, large horticultural associations use water in a centralized way. They have artesian wells where there is good water, but not all of this has been formalized,” the prime minister explained. “I asked the governor of the Moscow region. 20 thousand horticultural associations, the region is rather big, about 7 million people, and only a quarter of water use is somehow formalized. This means that three quarters will have to obtain these licenses if there is centralized water use. "

If they are forced to receive a new license, then “each partnership will pay a million rubles (and for gardening this is a lot of money) just to be allowed to use the water that they already use, especially since most of these wells were dug for people's money. "

Prime Minister Dmitry Medvedev believes that it is fair to establish the same electricity prices for horticultural associations and for the rural population.

The conversation took place, as they say, in the fields - on the territory of a large gardening non-profit partnership "Khimfarm", which united about 1300 dacha farms. However, in fact, this topic affects almost half of the country - almost 60 million people go to suburban areas.

The current law on horticultural associations was adopted 20 years ago and is already hopelessly outdated. Land issues and problems with unregistered objects in dacha plots were resolved through the "dacha amnesty". As a result, since 2007, about 12 million buildings have been re-registered under a preferential procedure. There are problems associated with the management of partnerships: how the amount of contributions is determined, how the register is maintained, how the rights of members of cooperatives are exercised. “Therefore, we decided that it makes no sense to change the current law - it is quite outdated - and to do everything in a complex, create a new law,” the head of government told the gardeners.

First, the new law codifies the types of real estate that can be built on garden plots. "It can be a garden house, which does not require a building permit at all. Or, this is a new norm of the law - a full-fledged house can be built on the site as an individual housing construction object and in this house you can register for permanent residence," Dmitry Medvedev briefly explained content of the document.

Secondly, the bill defines a unified, non-competitive procedure for allocating land to gardeners, which will allow unused plots to be brought into circulation. Third, the forms of horticultural associations are determined. There will be two of them - horticultural and vegetable gardening. Fourth, only three types of contributions are established for the participants of such cooperatives - introductory, target and membership. All others are canceled. "And a closed list of areas for which they can be spent is being established," the head of the cabinet stressed.

Fifth, the concept of public property of partnerships is introduced, which cannot be divided. Finally, the bill specifies the procedure for creating gardening partnerships, and in order to bring the existing associations to the new standards, the prime minister specified, no re-registration will be required - it will be enough to amend the charter. Dmitry Medvedev expects that all these innovations will be useful: "They will simply make life easier for people who constantly use their garden plots."

The list of problems that concern summer residents is much more, and often they are much more mundane. Member of SNT "Khimfarm" Oksana Polyakova raised the issue of cadastral valuation of land plots for tax purposes. Sometimes neighboring plots have different cadastral values, because the assessment was carried out by different firms.

"On January 1, 2017, the law on state cadastral valuation comes into force," the Prime Minister recalled. A unified federal assessment methodology is being introduced throughout the country, and this will be done by public sector entity... Moreover, for her mistakes, the head of the cabinet specified, she will have to compensate for the damage in full.

For many dacha cooperatives, road problems remain relevant. Municipalities cannot take on the balance of roads that they did not build, funds for them are not allocated accordingly, so summer residents have to repair them at their own expense. Dmitry Medvedev was asked to think about putting on the balance sheet of municipalities ownerless roads and access roads to horticultural associations. “We will strive to do this,” the head of government cautiously promised. But one cannot simply order the regions - funds are needed to maintain these roads.

The main thing is to determine the order so that later there are no questions from the regulatory authorities, - representatives of local authorities responded.

If the municipality recognizes the road as a public road, then it is accepted on the balance sheet, - commented on the situation from the Ministry of Transport.

It also depends on the regions at what prices horticultural associations receive electricity. Now they are equated to the category "population", and the regions have the right to introduce benefits. Gardeners would like to see electricity sold to them as rural population - cheaper. "We must get together and discuss with the regional leaders whether they are capable of making such a decision in all horticultural associations, but such a decision could be made as a recommendation," the prime minister reasoned. "From the point of view of justice, this seems right to me."

SNT covers an area of \u200b\u200b82 hectares and includes 1353 garden plots. More than 1200 people are members of the gardening partnership. D. Medvedev: I am glad to have the opportunity to meet with you, to discuss the problems that concern almost 60 million people in our country. This figure, of course, boggles the imagination: half of the country is summer residents, half of the citizens of our country are in one way or another connected with summer cottages and gardening. In fact, dacha farming is a unique phenomenon. Probably many people know that in foreign languages, at least in english language, the word "dacha" is borrowed from the Russian language, and it sounds so in English. This is interesting, but in reality it means that this is a purely Russian phenomenon. Of course, there are also houses in nature there, but they do not have such a special dacha way.

Therefore, the topics that we will be considering today are indeed very significant for a large number of our people. I see the point in discussing all these issues so that we understand whether we are on the right track in terms of a number of decisions that we must take. These are, first of all, legislative decisions related to various problems.

Some of the problems arose back in the Soviet period, when people were allocated six hundred square meters from enterprises and organizations, and the citizens of our country somehow settled down, supplied electricity, gas, water, roads. The regulation was very strict then, there were all sorts of prohibitions, restrictions, limits on the size of the house, and so on. Then all this disappeared, and in the 1990s everything went on its own. Someone continued to live in a typical seasonal house, someone built a full-fledged housing on the garden plot. There was a huge number of gaps in the legislation, various uncertainties that still affect.

Let me remind you that the current law "On horticultural, vegetable gardening and suburban non-profit associations of citizens" was adopted almost 20 years ago. It is pretty much outdated, of course. During this time, the solution of property issues, land, urban planning has gone ahead. And people continue to face a number of problems. The most elementary and important thing for a significant part of people: is it possible to register at the place of residence in the country? The Constitutional Court, as you know, answered these questions positively, but this norm still did not get into the law, and uncertainty remains.

We are preparing amendments, quite recently a "dacha amnesty" was held. This "amnesty" really brought a lot of positive things. Gardeners were able to register their plots and houses under a simplified procedure. This is good, because all this was hanging in an incomprehensible state, in an unsettled state, it was impossible to figure out who owned what, and it was just normal to transfer the rights to the land, the house, to everything related to gardening.

There are also problems with the management of horticultural partnerships, including how contributions are determined, how they are spent, how a register of horticultural partnerships is maintained, what issues are put to a vote, how the rights of those who are members of a horticultural partnership are who owns real estate but is not a member of a horticultural partnership. In general, this is a rather large set of problems.

Therefore, we decided that it no longer makes sense to change the current law, it is rather outdated. We need to do everything together, create a new law. This work was carried out at the site of the Ministry of Economic Development. Minister of Economic Development Alexey Valentinovich Ulyukaev is present here. I want to inform you that last week we considered this bill at a government meeting. I specifically suggested that we give some more period to revise the law, meaning our meeting with you. Because if some issues that were not included there, but should be integrated into the law, should be reflected in it, we will be able to do this after today's meeting. We will listen to all the opinions that exist and submit the final bill to the State Duma for consideration.

This is very important because this is, in fact, the "constitution" according to which horticultural and horticultural associations in our country will live in the next few decades.

I will outline a few fundamental points - they are legal, but most of the problems that gardening partnerships face are of a legal and organizational nature.

First, the types of real estate that can be built on garden plots are systematized. It can be a garden house - there are houses like, for example, here, for which no building permit is required at all and which are intended for temporary, seasonal residence. Or (and this is a new norm of the law, as they say, a short story) on the site it will now be possible to build a full-fledged house from the very beginning, as an object of an individual housing construction, and in this house you can register at the place of residence. Thus, we completely remove the previous bans in this area at the legislative level. Or a garden house, or a dwelling house, if you want and have the opportunity to build such a house, and you can register in it.

Second. The draft law defines a unified, non-competitive procedure for allocating land to gardeners that is in state or municipal ownership. The current law establishes a competitive tender procedure. Now this requirement is removed. This will allow unused land to be brought into circulation.

The third thing I would like to say is that the forms of horticultural organizations are being systematized. The insignificant differences between the garden and summer cottages, which spoiled people's nerves, are eliminated. Now partnerships will be created of two types - we offer horticultural and horticultural.

Fourth - on contributions. Contributions are also systematized. They can be of three types: introductory, targeted and membership. And various others are canceled in order not to create any uncertainties. A closed list of areas is established for which the collected funds can be spent, so that there is no doubt about the transparency of the spending that the partnership itself carries out. This will reduce the margin for abuse there.

Fifth, I would like to say: the right to the property of the general use of the partnership is being brought into line with the law. This is analogous to the apartment buildings in which many live. That is, it is the property of common use that arises that is not subject to any division.

Sixth. The bill specifies the procedure for creating partnerships, registering them and allowing households to be combined within the already built-up territories, if there is a desire to create a gardening or summer cottage economy. The procedure for acceptance, exclusion from the partnership, as well as a number of other issues is determined.

Highly important point, to which I would like to draw your attention right away: transitional provisions are directly established there for all existing horticultural associations, no re-registration is required. You just need to change the charter, and that's it. No formalities are required, just a change in the charter. There is no need to make changes to the title deeds for real estate. If someone wants to, then please, and so, in general, this will not need to be done.

I really hope that all these innovations will not only be useful to all our horticultural, horticultural and dacha farms, but also simply make life easier for people who constantly use their garden plots, dacha plots, will solve a number of other problems that are purely economic nature. Of course, we will also talk about them today - I mean connecting to electricity, gas, water supply, improving the general condition of roads leading to farms, landscaping and a whole range of other tasks.

Ivanov (member of SNT "Yagodka"): 171st the federal law, which amended the Land Code, today allows summer residents and gardeners to legitimize the unintentional seizure of land, which arose due to a number of technical problems long ago, when plots were measured in steps. This, of course, intensified the registration of land plots on cadastral registration, but at the same time many gardeners faced the problem of timing. It's not a secret for anyone that there is a massive overlap of land plots on top of each other or on common areas. So that these controversial issues allow, need a long period. Cadastral engineers who conduct land surveying give three months for this. Sometimes during this time it is not possible to solve all the problems, because, as a rule, an appeal to the courts is required. Is it possible to consider the possibility of increasing these terms for conscientious summer residents - from the moment of filing an application to a complete solution of some controversial issues?

D. Medvedev: This is a very specific problem, it affects a large number of people. The only suggestion I have is: let's get rid of the term "unintentional land grab". This is in the past, it is not a seizure, it just needs to be properly formalized.

The 171st law that you mentioned is a really important law. He settled issues that relate to the provision of land, including issues related to cutting, issues that may be related to the imposition of one plot on another. In general, these processes are ongoing throughout the country, but if we talk about the timing, this problem probably exists.

Since 2007, more than 12 million real estate objects for summer residents and gardeners have been re-registered under a preferential procedure. When we discussed this, we did not even imagine how many people it would affect. Which means that it was absolutely the right decision... Because this state irritated people: you have something, but you have no right to it; you invest money there, but it is not clear what the fate of this land or part of the house is. This, of course, strained the authorities, because it is not clear whether this is still a violation of the law or is it a legitimate activity that should be encouraged. As a result of the amnesty, this situation has been cleared, and this is very good.

Regarding the timing of the extension of cadastral registration. This period is 10 working days. But if border crossings are identified, then the period you mentioned comes into force - three months. If I understand correctly, you think that three months is not enough; it does not fit into three months. A new law on state registration of real estate comes into force, an extension of this period is allowed there, at the request of a citizen, the cadastral registration procedure can be increased to six months. To do this, you need to write an application to suspend this registration. But if you think six months is not enough, we can consider a longer period. But it seems to me wrong to stretch this indefinitely, because the goal is not to stretch the deadline, but to register everything. After the entry into force of this law, the term will be extended to six months. If required, we can introduce longer terms.

O. Polyakova (member of SNT "Khimfarm"): Polyakova Oksana Sergeevna, member of SNT "Khimfarm". For many horticultural partnerships, for the majority, there is a problem of registering summer cadastral plots for tax purposes. It turns out that neighboring plots have different cadastral values, and this is due to the fact that the assessment was carried out by different appraisers. The higher the value of the land, the higher the owner pays the land tax to the local budget, and the appraisers often work in the interests of the local government. In this connection, there is a proposal: to conduct a cadastral valuation government organizations according to a single standard in order to avoid low-quality work of private appraisers.

D. Medvedev: Here it is quite simple for me, Oksana Sergeevna, to answer your question. This topic also applies to horticultural associations, and a number of other land objects. People complain all the time, and not only ordinary citizens, but even companies, legal entitiesthat the assessment is carried out in very different ways, according to different methods and the result is very different. And very often it happens that two neighboring plots are not the same. Appraisers may have different goals - both legitimate and completely illegal, but the fact is that such a situation needs to be finished. Since January 1, 2017, the law "On state cadastral valuation" comes into force in our country, and a budgetary organization, a budgetary institution will be engaged in this. That is, in other words, it will be a unified federal methodology throughout the country. So that it doesn't turn out that one site costs five times more than the one next to it. It is clear that there may be different sizes, and all sorts of inconveniences may be, but nevertheless, the technique should be the same. Moreover, by this law, which comes into force on January 1 next year, losses that may be caused as a result of violations of this law in determining the cadastral value will be reimbursed in full at the expense of this institution. That is, this institution must work correctly, well, in good faith, otherwise it will pay for it. It seems to me that this is the correct, good norm. And she will help.

V. Kotov (Chairman of the Tver regional branch of the All-Russian public organization "Union of Russian Gardeners"): Most of the plots were developed by people with their own means, that is, they used their own funds to build roads, somewhere power lines. Today, many power lines are on the balance sheet of SNT, and some are ownerless, and if some kind of natural disaster happens, for example, a hurricane, wires are torn, poles fell, it is very difficult to find an owner who will deal with these consequences.

Electricity is sometimes the only resource in a horticultural partnership, that is, gas is not available everywhere, and this is a very important point. Tariffs are growing today, they are different, and often SNT, which are located near cities, become part of cities, part of settlements. Of course, I would like professional teams to deal with uninterrupted power supply services, that is, those regional federal companieswho are directly involved in this type of activity. It would suit everyone.

But there is one more thing: today urban tariffs differ from rural ones, and most of our gardeners today pay for electricity at city tariffs. Often they are powered from one substation, and villagers pay at the rural rate, and SNT participants pay at the city rate. We have such a wish - to equalize this tariff so that all gardeners in Russia (and the bulk of gardeners are pensioners) pay according to rural tariffs. And make sure that power lines are transferred to regional network companies with experience, with a good, impeccable reputation. Then we will have high-quality uninterrupted power supply.

D. Medvedev: You raised a slightly more difficult topic than legal adjustments, because the law is somewhat easier to write than to pass economic solutions... Nevertheless, the very formulation of the question is absolutely fair. In fact, you have raised two questions.

The first is what to do with the networks that exist in the SNT, with the network economy, which was built in different periods for different reasons and is on different balances. In general, this approach needs to be approved in order to transfer these networks to content special organizationswho should do this, because it is still an infrastructure, and quite complex, and, in fact, an object increased danger... Of course, there should be a unified regulation, maintenance and, ultimately, a unified service for the electrical equipment itself, which was created.

It is not very easy to do this, because this is a large economy, but nevertheless we have such a strategy for the development of the electric grid economy, where it is directly stipulated that in the case when there are orphan networks or networks that organizations refuse for one reason or another, they must be accepted on the balance sheet of power grid companies. This is correct, based on the state approach. You yourself say that during any accidents it is very difficult to fix everything, it is expensive. Although legally, of course, it is the partnership itself that is responsible for this, which once either received consent to build a network, or did not, but in any case it is subject to registration now. This is a continuation of the very "dacha amnesty", the legalization of the economy that has been created over the course of decades, therefore, in general, I support this approach. We will strive to carry out such a transfer.

Now with regard to tariffs. Here the situation is as follows: in principle, the size of the tariff is not a federal decision, but a regional one. In different regions, these problems are treated differently, but according to the current rules, horticultural associations in our country are equated to a category of consumers called “population”. Electricity is supplied to them at state prices, and the regional authorities have the right to establish reducing coefficients for these tariffs, that is, to establish preferential tariffs, up to those tariffs that apply to rural residents.

Therefore, we must discuss with our colleagues - regional leaders whether they are now capable of taking such steps in all horticultural associations, because these will be their decisions. But as a recommendation - such a decision could be made - for the heads of the regions and regional energy commissions to make a decision on equating gardening associations with rural residents. In any case, from the point of view of fairness, it looks right.

N. Didukh (member of SNT "Lavsan"): Gardening Society "Lavsan", Didukh Nelly Petrovna. Every spring, summer residents flock to specialized stores to buy seeds. I must say that we sell a lot of seeds. Basically, seeds come to Russia from Poland and Holland. But, unfortunately, they are not entirely acceptable in our climatic conditions... There are, of course, domestic seeds, but there are big claims to quality - somewhere around 50% germination. Plus, there is always a re-grading: you plant one vegetable, and a completely different one grows. And the seeds are quite expensive. Since summer residents are mostly pensioners, this costs them a pretty penny. In this regard, I have a request from all summer residents to strengthen border control over phytosanitary products, imported seeds, and to approach counterfeit products very strictly. And, of course, we need to support our russian manufacturers seeds, because our seeds really suit us better. Only that they are of good quality.

D. Medvedev: Nelly Petrovna, firstly, the problem of seeds, the problem of breeding and seed material, unfortunately, did not arise today. This is, if you like, a threat to national security. This is not only the problem of what cucumbers and tomatoes we have appeared in our garden plots, it is also a problem of whether they will block the flow of seeds at some point, and can we then just sow normally if we do not have our own material enough. Therefore, the number one task on a national scale is to support selection production, selection, genetics, and naturally seed production. This has now become a development priority. agriculture.

More recently, we were puzzled by other questions - how to simply revive plant growing, how to engage in normal livestock raising so that the livestock population increases. Now these tasks have been solved. We are doing very well, we have wonderful harvests. In the Kursk region, for example, this year there will also be an unprecedented harvest, apparently harvested. But material - yes, that's a problem. Therefore, we allocate a significant part of the money under the agricultural development program for these purposes. I hope that in the coming years, both agricultural enterprises and ordinary gardeners will receive normal seeds, moreover, adapted to our weather conditions. This is also not an easy task, because our country is rather big, and the seeds that are used in the Leningrad Region should in some way differ from those used in the Kursk Region, and so on. It is also a problem of zoning throughout the country. This is the first thing.

The second is on border control over sanitary and phytosanitary requirements. I absolutely agree with this. This is generally a threat too, and you need to watch for it. There are colleagues from the Ministry of Agriculture and Sanitary and Phytosanitary Control. We will definitely do this.

The last one is about counterfeit. The problem is also absolutely obvious. When you buy seeds in a store, it is impossible to understand what will come of it, despite the fact that they are sold in bright packages, they beautiful names... But what will come of this is unclear. And then it is almost impossible to make claims to someone, because even if it is a reputable company, it will say: yes, you planted in the wrong conditions, did the wrong thing. We need to switch to our own technologies here. We will definitely do this.

O. Lesnaya (member of SNT "Romashka"): In gardening associations, as well as throughout Russia, roads are the main problem. Access roads to partnerships should be run by municipalities. Often these roads remain uncompleted, not put on the balance sheet. The fact is that the municipality cannot put it on the balance sheet, since it did not build this road. And a gardening partnership, since it has not formalized an easement and has not legalized the right to land, also cannot put it on its balance sheet.

We have a proposal: to put on the balance sheet of municipalities the ownerless and existing access roads to horticultural associations.

D. Medvedev: The problem, unfortunately, is much more complicated. It is not enough to put on the balance sheet, you have to keep them, and to keep them is money. Nevertheless, as a general approach, this is probably correct. Because, although our country is huge, it should not have ownerless roads, by the way, as well as ownerless power grids and substations. It’s just not comfortable, and sometimes even dangerous. That is why car roads of general and local significance, in fact, should form the backbone of this kind of road infrastructure. Naturally, we will strive to do this.

Each region should have certain plans for itself, how it brings such roads into circulation, how it puts them on the balance sheet, of course, with the necessary financial support. Because otherwise it will mean that here it was ownerless, of an ugly quality, and now it will simply be formally owned by the municipality, but this will not improve the quality. Therefore, it is necessary to simultaneously provide for income sources. What could it be? This, of course, comes from the municipal road fund. As far as possible, they should be directed towards these goals. It is clear that there are no huge funds there, but nevertheless it is possible. Secondly, these are subsidies from the higher budget. In this case, the superior budget is the budget of the region - the Kursk region or any other region, by analogy with the federal budget.

This is how, step by step, we need to involve these roads in everyday life, because otherwise they will degrade with us, they will become worthless. And we also need to look at which areas are promising and which are less promising. So, if you think in a businesslike way, sometimes you need to find money so that the road in the direction of gardening is repaired, brought into proper condition, because a lot of people travel. Some roads are hardly used at all, and the gardening partnership there, in fact, may have disintegrated or does not work as it should, that is, here you need to proceed from the principle of expediency. I will definitely give this kind of assignment to my fellow governors.

N. Asaul (Deputy Minister of Transport Russian Federation): We have both the law on road activities and the law on horticultural associations spelled out the corresponding norms. If a municipality or a constituent entity of the Russian Federation recognizes a road as a public road, then, accordingly, such a road is accepted on the balance sheet and there is no need to accept additional powers or methods for classifying a particular road as public roads. As for the relationship with the union, I think that in this sense the union has nothing to be offended, the relationship with the government has been established. Horticultural associations are beginning to conduct environmental audits on the use of wells for water production. We are talking about a license for wells. Fines for individuals are set at three to five thousand rubles, for partnerships - up to one million rubles. Obtaining a license is not only an expensive process, but also quite lengthy. Are such checks and fines legal? Is there a deadline set by federal law for obtaining a well license?

D. Medvedev: When I was preparing for our meeting, I looked at publications on well licensing, fines for refusing to obtain a license, for unregistered licenses and all sorts of other problems, including fees that some organizations are already beginning to collect in order to quickly get a license. There is no doubt about the law, it was specially adopted in order to streamline the use of water. Water is a value, you really need to control what happens to it. But the fact that some organizations are asking for money in order to obtain such a license from the established authorized state bodies is a complete disgrace. These licenses were not introduced in order for intermediaries to make money on them.

In connection with this, I had an idea. Actually, I have already instructed my colleagues in the Government and governors to work it out, this applies to all regions. If we are talking about the water use of an ordinary member of a horticultural partnership up to 100 cubic meters of water, this does not require licensing. These are quite decent numbers that allow a specific person to use water without excessive bureaucracy. But the fact is that many of our strong, large horticultural associations use water in a centralized way. They have artesian wells where there is good water, but not all of this has been completed. I asked the governor of the Moscow region. He has about 20 thousand horticultural associations, the region is rather big, about 7 million people, and only a quarter of water use is somehow formalized. This means that three-quarters will have to receive these licenses if there is centralized water use. Do you understand what this will result in? Each partnership will pay a million rubles (and this is a lot of money for gardening) just to be allowed to use the water that they already use, especially since most of these wells were dug for people's money.

What's the idea? We need to be sure to control what happens to our water. This is really a great value. In our country, although it is very large and we have 20% of the world's water reserves, we cannot refuse licensing. But for all users whose wells arose before the entry into force of this law and who are already in operation, all these licenses should be renewed automatically and free of charge. Just register, say, there is a well, this well is known to us, it is located in such and such an area, has such and such coordinates, has such and such depths, and that's all, and don't take a dime. That is, in fact, we would hold an amnesty in this area. It seems to me that it would be correct. And whoever applies again, new partnerships, let them receive a license in the prescribed manner. I think it will be fair. And we will definitely bring this idea to life.

“Therefore, the number one task on a national scale, I will say frankly, is the task of supporting selection production, breeding, genetics and, of course, seed production,” he added.
