PROVISION OF GOVERNMENT SERVICES IN THE "LIFE SITUATION"

1. General Provisions, basic terms and definitions

1.1. The basics systems approach to the organization of the work of the executive authorities of the city of Moscow and city organizations to provide public servicesassociated with the issuance of the requested documents, according to the "life situation" are:

Maximum simplification of the paperwork procedure for applicants;

Elimination of the need for the applicant to obtain intermediate or duplicate documents;

Providing the applicant with the possibility of a single submission of a set of documents for obtaining required package government services;

Minimization of time costs during paperwork.

1.2. When organizing work on the provision of public services for the "life situation" in the city of Moscow, the following terms and definitions are used:


Composite public service is a public service consisting of several elementary services.

Applicants - individuals and legal entities, individual entrepreneurs who apply to the executive authorities, government agencies for obtaining the necessary government services.

Service holder - the executive authority of the city of Moscow, other city organizations providing services, including those related to the issuance of the requested document.

Life situation is an event in the life of a citizen or in the activities of an organization that entails the need to receive a set of interrelated government services, as well as required documents in accordance with the current legal framework.

Regulations for the provision of services in a "life situation" - the procedure for interaction between individual executive authorities of the city of Moscow and city organizations approved by a legal act of the Moscow Government in the course of fulfilling the requests of applicants for the provision of public services in a "life situation".

The Unified Register of Documents is a list of documents drawn up and issued by the executive authorities of the city of Moscow, state institutions and state unitary enterprises of the city of Moscow.

Approval (examination) - a decision (conclusion) of an executive body of the city of Moscow, a city organization, a federal executive body and (or) its territorial body, an independent expert, necessary for the preparation of the document requested by the applicant, carried out in accordance with the preparation procedure approved in the prescribed manner document on the principle of "one window" or regulations for the provision of services in a "life situation".

Obtaining approvals (examinations) is carried out exclusively in cases directly provided for by regulatory legal acts Russian Federation or the laws of the city of Moscow.

If it is necessary to use intermediate information that is at the disposal of any city organization for processing a request for processing a document, it is obtained by organizing access to an executive authority, state institution or a state unitary enterprise of the city of Moscow to the corresponding information resource.

Approving organizations (experts) - executive bodies of the city of Moscow, city organizations, authorized federal executive bodies, their territorial bodies, independent experts participating in the preparation and (or) approval of the requested documents issued to the applicant.

Document preparation regulations - the procedure for organizing the work of the executive authority of the city of Moscow or a city organization for the receipt of documents directly related to the applicant, preparation, approval and issuance of the requested document to the applicant.

2. Formation of the list of public services

2.1. The formation of the list of public services for the "life situation" and their composition is carried out by the Moscow State Services Committee on the proposals of industry and territorial bodies executive power of the city of Moscow.


2.2. The structure of the state service for the "life situation" may include services, the results of which do not result in the issuance of any documents.

2.3. Information about the provided state services in the "life situation" is fully posted on the Portal of state services.

2.4. The provision of state services in the "life situation" is carried out by the executive authorities of the city of Moscow and other city organizations.

2.5. Responsible for the provision of services in the "life situation", carrying out the receipt of requests from applicants, are:

2.5.1. Executive authorities of the city of Moscow and their subordinate organizations - holders of "one window" (in the case of rendering services with minimal participation of third-party organizations).

2.5.2. Service centers for the population and organizations on the principle of "one window".

2.5.3. Citywide Center for the provision of public services to individuals and legal entities.

3. Regulation of procedures for the provision of state

services for "life situation"

3.1. The regulations for the provision of public services in a "life situation" (hereinafter referred to as the regulations) are developed in accordance with these Regulations, as well as additional recommendations on their content and approved by resolutions of the Moscow Government.

3.2. Responsible for the development and approval of regulations are the executive authorities that provide such services or coordinate the activities of the relevant subordinate organizations.

3.3. The regulations for the provision of public services in a "life situation" in service centers for the population and organizations on the principle of "one window" are developed centrally by the Department of territorial executive bodies of the city of Moscow.

3.4. The development of regulations is carried out in accordance with the list and composition of these services, formed by the Committee for Public Services of the city of Moscow.

3.5. The order of work of the services providing state services in a "life situation" is determined by internal regulations approved by the heads of the executive authorities of the city of Moscow in charge of these units.

3.6. Internal regulations should not conflict with these regulations.

4. The procedure for accepting documents from applicants for provision

public services for the "life situation"

4.1. Requests for the provision of public services for the "life situation" are accepted authorized bodies the executive power of the city of Moscow and city organizations in the form established by the regulations.

4.2. The list of documents required to receive the requested service is determined by the regulations and current legal acts.

4.3. When accepting documents, employees of bodies providing public services in a "life situation" must:

4.3.1. Check the correctness of the application, the completeness of the documents submitted by the applicant, necessary to receive the requested service. In case of inconsistency or lack of the necessary documents, the application is not accepted and a brief explanation of the inconsistency is given.

4.3.2. Register an application in the organization's electronic document flow database with automatic generation of an extract from the electronic register and control of applications of applicants and assigning an appropriate identification number (hereinafter - ID).

4.3.3. Put a stamp on the acceptance of documents indicating the date, time, name and signature of the accepted employee, ID on the original application submitted by the applicant.

4.3.4. Hand over to the applicant an extract from the electronic register and control over applications of applicants, certified by the signature of an employee of the organization and a stamp.

4.3.5. If necessary, provide the necessary consulting services to the applicant to explain the procedure for the provision of services in a "life situation", familiarize him with regulations, regulating the work of the organization.

4.4. If the documents requested by the applicants are drawn up and issued on the day of application, extracts from the electronic register and control over applications of applicants by the organization that provides public services are handed over to the applicants only at their request.

4.5. In cases of issuing documents with a deadline on the day of application, it is allowed to work with applicants on oral requests without filling out an application in writing. Accounting and control over the execution of these requests are carried out in accordance with the procedure established by these regulations.

4.6. The reasons for refusal to accept documents from the applicant may be:

4.6.1. Application of the applicant on issues, the solution of which is not carried out within the framework of the provision of services for the "life situation".

4.6.2. The applicant does not have a complete set of documents specified in the regulations.

4.6.3. Submission by the applicant of invalid or incorrectly executed documents.

4.6.4. Absence of a power of attorney drawn up in accordance with the procedure established by law (in the case of an application for execution of a requested document to be issued to a third party, or a power of attorney to act on behalf of the organization).

4.6.5. The applicant's refusal to pay in the established amount of work (services) performed (provided) on a reimbursable basis, or to submit receipts for payment.

4.7. At the request of the applicant, a refusal to accept documents by an organization providing state services in a "life situation" can be formalized and issued to the applicant in writing.

4.8. Any other reasons for refusing to accept documents from the applicant are unlawful and can be appealed by the applicant to the head of the executive authority of the city of Moscow or a city organization coordinating the work of this service, or in court.

5. The procedure for the provision of services for the "life situation",

including those related to paperwork

5.1. An organization that accepts a request for the provision of services in a "life situation" carries out work in cooperation with the executive authorities and city organizations defined in the regulations.

5.2. The accepted request is sent to the co-executing organizations to provide applicants with certain elementary services in departmental areas.

5.3. The transmission of requests for execution is carried out both using paper carriers (originals or copies), and by transferring information through telecommunication channels.

5.4. The organization that received the relevant request is obliged to register it with in electronic format and inform the structure responsible for the provision of the "life situation" service in general about the receipt of sufficient documentation.

5.5. The provision of certain elementary services is carried out within the framework of the regulations for the preparation of documents on the principle of "one window" and the regulations for the provision of services in a "life situation".

5.6. Sending a request for execution can be carried out according to a sequential (in cases where each subsequent service can be provided only on the basis of the previous one), parallel (several services are provided simultaneously) or a combined scheme.

5.7. The document formed as a result of the provision of each elementary service can be issued to the applicant both by the organization that carried out its direct preparation, and by the organization that initially accepted the request, in a package with the rest of the documents.

5.8. In the case of an independent issuance of a document to the applicant, as well as the provision of a public service that does not ultimately require the execution of any documents, the executing organization notifies the organization that accepted the initial request of the results of the provision of the service.

5.9. The organization, which is responsible for the provision of services in a "life situation", monitors the observance of the general term for the provision of services, determined by the regulations, as well as the terms of the provision of elementary services by co-executing organizations.

5.10. An organization that provides services for a "life situation", as well as co-executing organizations, provide data submission to the System of control and monitoring of the work of the executive authorities of the city of Moscow on the principle of "one window" on approved regulations and data transfer formats.

6. The procedure for issuing the requested documents to applicants,

issued as part of the provision of public services

by "life situation"

6.1. The issued documents are issued on paper or in the form of a plastic card (in cases stipulated by law).

6.2. The issuance of a document or a reasoned refusal is made to the applicant:

6.2.1. To an individual in the presence of an identity document, or to a representative of the applicant in the presence of a power of attorney drawn up in the prescribed manner for the right to receive a document and an identity document.

6.2.2. The representative of the organization, if there are identity documents and confirming the authority of the representative of the legal entity to act on behalf of the legal entity.

6.3. When issuing the requested document or a reasoned refusal, the employees of the organization must:

6.3.1. Issue the requested document or a reasoned refusal in the manner prescribed by the regulations.

6.3.2. Issue, if necessary, properly executed accounting and other financial documents related to payment for the preparation of the requested document.

6.4. The applicant confirms the receipt of documents with a personal signature with a decryption in the corresponding column of the second copy of an extract from the electronic register and control over applications of applicants in the organization, which is stored with the application in the archive.

6.5. The fact of receipt by the applicant of documents is recorded in electronic form.

6.6. Refusal to issue a document to the applicant must be motivated, formalized in writing and, if possible, accompanied by recommendations on further actions necessary to obtain the document.

6.7. The reasons for a reasoned refusal to issue the document requested by the applicant may be:

6.7.1. The applicant has no right to the document requested by him.

6.7.2. Establishment by the applicant of incorrectly executed or invalid documents, if the specified circumstances were established during the preparation of the final document.

6.7.3. The impossibility of preparing a document due to circumstances previously unknown when accepting documents.

6.7.4. Negative opinion of the executive authority of the city of Moscow, city organization, as well as the expertise required to substantiate the decision (approval) of the executive authority of the city of Moscow or city organization, which is attributed to the powers of this body (organization) in accordance with the law.

6.7.5. The applicant's refusal to pay for the work (services) performed (rendered) on a reimbursable basis, as well as to submit properly executed payment documents.

6.8. Refusal to issue a document may be appealed by the applicant with the head of the executive authority of the city of Moscow or the city organization issuing the document, or in court.

7. Storage of documents drawn up as part of the provision

services for "life situation"

7.1. The unclaimed document is stored for the established period of its validity, but not less than one year from the date of its receipt, production or registration by the "one window" service, and then transferred in the prescribed manner to the archive of the "one window" holder.

7.2. The storage period for documents received from the applicant for the preparation of the requested document to be issued on the basis of the "one window" principle, and other documents on executed applications is 3 years from the date the requested document was issued to the applicant, a reasoned refusal, or if the applicant does not require the prepared requested document, no later than expiration date of its validity, unless otherwise specified by the legislation of the Russian Federation and the city of Moscow.

7.3. Upon the expiration of the storage period for the unclaimed requested document specified in this resolution, specified document is considered invalid and subject to destruction in accordance with the established procedure, unless otherwise specified by the legislation of the Russian Federation and the city of Moscow.

ANNOTATION

The provision of "comprehensive" state and municipal services is another step towards improving their quality and towards a "service state". Simplifying application procedures is an important step towards proactive service delivery.

Nevertheless, in practice, there are a number of administrative restrictions on the provision of services within the framework of "life situations", including both legal regulation and the organization of the process in multifunctional centers.

Trends in the development of a service-oriented state in terms of the provision of public services imply ensuring the transition from receiving public services to integrated services of the final result that the applicant needs (for example, all the necessary actions when buying a home or when giving birth to a child, etc.). Each public service must be “embedded” in all user-friendly interfaces and processes for which the applicant is forced to apply separately. The concept of reducing administrative barriers in 2011-2013 outlined the direction of development of the sphere of public services: from the regulation of each state and municipal service to the improvement and description of complex services for "life situations", which require standardization and legislative consolidation.

Despite the fact that the implementation of the idea of \u200b\u200bproviding services within the framework of “life situations” should entail serious changes in the relationship between the applicant and the state, including improving its quality, there is still no legal regulation of the provision of public services in accordance with this principle by the authorities, as well as and the legislative definition of the term.

In the domestic literature, the situation is similar. Research in the field of this problem is not systematic, which does not contribute to the formation of a holistic view of the trend of changes in the provision of state and municipal services among practitioners and the interested public.

By the life situation, Kitrar is understood as “the totality of social relations arising on the basis of a certain legal fact (action or event) that occurred both at the will of the participants in these relations (starting a business, getting married, purchasing an apartment), and regardless of the will (illness, death) and connected with the need to apply to the authorities for obtaining the result of the provided public services required in the circumstances ”.

A.P. Isakov defines the life situation as "the totality of the factual circumstances existing in the applicant, with which the legislator associates the latter's right to apply for a comprehensive public service corresponding to the prevailing circumstances."

A life situation appears as a result of certain events that have occurred in a person's life and is associated with the need to interact with the authorities on this matter. At the same time, the life situation itself most often does not require directly receiving government services themselves. In such cases, they should become an invisible procedure for the applicant in solving a real life problem.

As a result, we can single out several of the most significant signs of a "life situation":

  1. the grounds for the provision of services "in life situations" are recognized as legal facts that confirm the emergence and requiring adjustments or termination of any public relations that have legal consequences;
  2. "Life situation" involves the combination of the most socially significant and massive state and municipal services, contributing to the fullest provision of the implementation of rights and obtaining the necessary results by applicants within the current circumstances, including several typical events;
  3. within the framework of the "life situation" there may be several development alternatives, options for the results of services;
  4. the range of services provided depends on legal status the applicant is an individual, entrepreneur, foreign citizen or legal entity.

Analytical systematized activity towards the transition of the provision of services within the framework of "life situations" in the constituent entities of the Russian Federation actually began only in 2015. The first attempts to implement the provision of a range of services were on the Unified Portal of Public Services , but up to the present time the applicant can only get acquainted with the list of services within the framework of his “life situation”. The next step in improving the provision of complexes of state and municipal services was aimed at developing ways of interaction between the citizen and the state through multifunctional centers.

In order to ensure legal regulation of the provision of services in “life situations”, by order of the Government of the Russian Federation dated February 19, 2018, No. 260-r, a list of 30 federal services provided as part of a complex request was approved. It is assumed that this measure will ensure an improvement in the quality of the provision of public services, namely, the receipt of services in a "one window", including on the principle of extraterritoriality.

From March 1, 2018, the norm came into force Federal law No. 210-FZ, according to which an application to the MFC is submitted once, the second application is to obtain a result, the multifunctional center can independently draw up on behalf of the applicant and send an application to the relevant authorities in accordance with a complex request. A single application for services will reduce the time and financial costs of citizens.

When applying to the MFC for services in connection with the current life situation, the applicant will submit only one set of documents and one application in the form of filling out a complex application, which involves the receipt of two or more services. In accordance with part 13 of article 15.1 No. 210-FZ, a complex request may include services that are not related to each other in a life situation and are not included in the standard compositions of interconnected services, in any quantity. In addition, Resolution of the Government of the Russian Federation No. 412 enshrines a number of provisions and norms that determine the procedure for interaction between MFC employees and applicants. The current situation in most multifunctional centers shows the impossibility of providing services on these terms. The implementation of services for "life situations" by some multifunctional centers is considered to be implemented if the list of services provided through the MFC includes all possible services that may be in a particular life situation. At the same time, the complex request has not yet been implemented, since not a single regulation executive body the authorities of the federal, regional or municipal level do not contain norms in which a complex request from the MFC will be the basis for the provision of a service.

Summarizing the above rule-making novels and the opinions existing in the scientific literature on the provision of public services in “life situations”, as well as comparing them with practical measures to improve the services of multifunctional centers, a number of conclusions follow.

First, at the present time in the Russian Federation there is no common understanding of the concept of “life situation” and approaches to their formation. In scientific literature and official sources, there are several definitions of this concept. On the official websites of multifunctional centers, the most common is the definition of a life situation as a certain set of state and municipal services, a set of support measures and social guarantees, which is able to provide a result according to the totality of the applicant's requirements, without highlighting individual parts that send a person to various departments.

Secondly, the problem faced by public law entities is the determination of the list of life situations and the state and municipal services contained in them. At the moment, there is no single list of both federal leveland at the regional level.

To ensure the quality and increase the efficiency of the organization of service delivery, it is necessary to conduct theoretical developments in terms of the formation of lists of services included in a specific "life situation". The services that form such complexes must meet a number of requirements, but first of all, the basis for the provision of a complex service must be a legal fact confirming this "life situation". In this regard, it is necessary to make amendments to the regulatory legal acts that expand the current list of state and municipal services provided in the MFC within a number of basic life situations that provide the opportunity to provide services on the basis of a complex request from the MFC, i.e. update the administrative regulations of state and municipal services.

In the near future, the list of services that multifunctional centers (MFC) provide Russians in the "one window" mode will significantly expand.

The MFC will have the right to issue birth and death registration, accept documents for obtaining a tax deduction and even accumulate duties and tax payments. Moreover, the very principle of providing public services will change. A set of common life situations will appear, within which a whole set of documents can be obtained from one application.

The Minister economic development Maxim Oreshkin said at the All-Russian Forum of Centers for State and Municipal Services. According to him, the bill on registration of birth and death registration in the MFC is in the State Duma. He should be accepted in the autumn session.

Another reform is related to the work of the Federal Tax Service. Now the Ministry of Economic Development and Trade is discussing with the Federal Tax Service the issue of launching a pilot project to provide three services. The first is to correct incorrectly assessed taxes, the second is to receive a tax deduction, and the third is to inform citizens about the tax debt. “Moscow's My Documents centers have actively and very successfully joined this process,” notes Maxim Oreshkin. “A month ago, the Federal Tax Service issued an order to implement a pilot project throughout the country. The MFC should already conclude an agreement on the provision of services through the Federal Tax Service.”

In addition, the Ministry of Economic Development proposes to give the MFC the right to accept payments against taxes and duties. Technically, there is such an opportunity even now - money can be deposited through bank terminals. However, according to the minister, this service is not available in all regions and not in all MFCs.

The bottom line is simple: a person who, for example, has a child, will be able to submit one application, but receive not one document, but the entire necessary range of services. "The Ministry of Economic Development is preparing a by-law base, which should ensure the correct implementation of the provisions of the draft law," Oreshkin continues. "In particular, a draft methodological recommendations for the provision of public services based on a comprehensive request for the most common life situations have already been developed. basic needs of a particular person. Some legislative acts may be developed following the results of the forum. Thus, the representatives of the regions agreed that the MFC system will not be able to develop without the complete transition of the authorities and My Documents centers to electronic interaction.

Information on the organization of the provision of state and municipal services in the framework of life situations: features, approaches, lists of state and municipal services in the context of basic life situations
Today, in addition to the actual creation of a network of multifunctional centers and the material support of their activities, ensuring an appropriate level of quality of service provision comes to the fore. One of the ways to improve the quality of the provision of state and municipal services is organization of the provision of state and municipal services in the framework of life situations.

Under life situation means a legally significant event in the life of a citizen or in the activities of an organization, in which it becomes necessary to apply for a complex of interrelated state and (or) municipal services, the provision of which is organized by a multifunctional center on the principle of "one window".
Currently, 9 main life situations have been identified, within which it is advisable to organize the provision of complexes of interrelated state and municipal services in multifunctional centers:


  1. The birth of a child, including:

  1. the birth of the first child;

  2. the birth of a second child;

  3. the birth of a third child (and subsequent children) - a large family.

  1. Individual housing construction.

  2. Starting your own business.

  3. Loss of documents.

  4. Old age retirement.

  5. Changing of the living place.

  6. Change of name.

  7. Loss of a loved one.

  8. Purchase of residential premises 1.
The specified list of life situations has been approved by the Ministry of Economic Development of the Russian Federation.

In order to organize the provision of state and municipal services in life situations, based on the results of a conference call on the development of a network of multifunctional centers in the Russian Federation on December 4, 2013, the Chairman of the Government of the Russian Federation D.A.Medvedev gave a number of instructions 2, in pursuance of which amendments were made to Decree of the Government of the Russian Federation of September 27, 2011 No. 797, expanding the list of state and municipal services. Based on this list, within the framework of each life situation, recommended lists of state and municipal services have been formed, the provision of which can be organized in multifunctional centers. These lists are presented in Table 1.

Taking into account the practice of providing state and municipal services in the constituent entities of the Russian Federation and municipalities on the territory of the constituent entities of the Russian Federation, the lists of state and municipal services, the provision of which can be organized in the multifunctional centers of the corresponding constituent entity of the Russian Federation within the framework of life situations, can be specified.
An analysis of the practice of providing state and municipal services within the framework of life situations in the constituent entities of the Russian Federation allows us to conclude that there are 2 approaches to organizing the provision of services within the framework of life situations, which differ in the way the applicant applies:


  1. The applicant submits to the MFC separate applications for each state (municipal) service within the framework of a life situation.

  2. The applicant submits to the MFC a single statement on the organization of the provision of state and municipal services within the framework of a life situation.
In preparation Methodical recommendations The second approach is being implemented by the Ministry of Economic Development of the Russian Federation to organize the provision of state and municipal services in multifunctional centers within the framework of life situations. Simultaneously with this, the Ministry of Economic Development of the Russian Federation prepared proposals on amendments and additions to the current legislation in order to implement the possibility of submitting a single application.
