For the use, including one-time, methods of upbringing associated with physical and (or) mental violence against the personality of the pupil, as well as committing any other immoral offense, the head of the circle may be relieved of his post in accordance with labor legislation and the Law of the Russian Federation "On Education ". Dismissal for such an offense is not a disciplinary measure.

Medical worker

The counselor is obliged to perform the following labor functions:

2.1. Promotes the development and activities of the children's collective (group, division, association) in various institutions (organizations) that work with children of different ages, including in health educational institutions organized during the vacation period or operating on a permanent basis (hereinafter referred to as institutions).

2.2. Provides assistance to the educator in programming the activities of pupils, children on the principles of voluntariness, initiative, humanity and democracy, taking into account their initiative, interests and needs.

2.3. In accordance with the age-related interests and requirements of the life of pupils, children contributes to the renewal of the content and forms of activity of the children's collective, organizes collective creative activities.

2.4. Together with the educator and other employees of the institution, he takes care of the health and safety of pupils, children, creates favorable conditions that allow them to show civic and moral stance, realize their interests and needs, spend their free time interestingly and profitably for their development, using the best experience of working with children and adolescents.

2.5. Provides protection of life and health of pupils, children during the educational process.

2.6. Interacts with the senior counselor, self-government bodies, teaching staff of educational institutions and public organizations.

2.7. Complies with the rules of labor protection and fire safety.

In case of official necessity, the counselor may be involved in the performance of his official duties overtime, in the manner prescribed by the provisions of federal labor legislation.

3. Rights

The counselor has the right:

3.1. For all social guarantees provided for by the legislation of the Russian Federation, including:

  • for reduced working hours;
  • for additional professional education in the profile of pedagogical activity at least once every three years;
  • for the main annual extended paid leave, the duration of which is determined by the Government of the Russian Federation;
  • for a long vacation for up to one year at least every ten years of continuous teaching work;
  • for the early appointment of an old-age labor pension;
  • to provide out of turn residential premises under a social tenancy agreement (if the employee is registered as needing residential premises);
  • for the provision of residential premises for specialized housing stock;
  • for the provision of compensation for the costs of housing, heating and lighting [for those living and working in rural settlements, workers' settlements (urban-type settlements)];
  • to pay additional expenses for medical, social and vocational rehabilitation in cases of damage to health due to an industrial accident and an occupational disease.

3.2. To get acquainted with the draft decisions of the management regarding its activities.

3.3. On issues within his competence, submit proposals for improving the organization's activities and improving working methods for consideration by the management, as well as options for eliminating the shortcomings existing in the organization's activities.

3.4. To request personally or on behalf of the management from structural units and specialists information and documents necessary for the performance of their duties.

4. Responsibility and performance evaluation

4.1. The counselor bears administrative, disciplinary and material (and in some cases stipulated by the legislation of the Russian Federation - and criminal) responsibility for:

4. Rights

The counselor has the right:

4.1. independently choose the forms and methods of work with students and plan it based on the general work plan of the children's collective (group, unit, association) and pedagogical expediency

4.2. participate in the management of the school in the manner determined by the Charter of the school;

4.3. to protect professional honor and dignity;

4.4. get acquainted with the complaints and other documents containing the assessment of his work, give explanations on them;

4.5. the confidentiality of the disciplinary (official) investigation, except for cases provided by law;

4.6. improve qualifications;

4.7. give children during classes and breaks mandatory orders related to the organization of classes and the observance of discipline,

5. Responsibility

5.1. For non-fulfillment or improper fulfillment, without good reason, of the Charter and the Internal Labor Regulations of the school, other local regulations, legal orders of the school administration, official duties established by this Instruction, the counselor shall be disciplined in the manner prescribed by labor legislation.

5.2. For the use, including one-time, methods of upbringing associated with physical and (or) mental violence against the personality of the student, the commission of another immoral offense, the counselor may be dismissed from his position in accordance with labor legislation and the Law of the Russian Federation "On Education". Dismissal for this misconduct is not a disciplinary measure.

5.3. For the culpable infliction of damage on the school or participants in the educational process in connection with the performance (non-performance) of his official duties, the counselor is financially liable in the manner and within the limits established by labor and (or) civil legislation.

Legal basis for the activity of a counselor

DOCUMENTS REQUIRED FOR EMPLOYMENT IN DOC

· Medical book.

In DOCs, which are assigned to certain medical centers, or have their own polyclinics, the management itself makes a medical book for the counselors. But this happens extremely rarely - in most cases, the counselor is given a slider with a list of doctors and tests. The Moscow government annually issues a decree during the summer camp campaign, on the basis of which the passage of doctors and the delivery of tests for counselors is carried out free of charge in the clinic at their place of residence, as well as in the skin and venereal clinic, where blood tests for syphilis and smears for sexually transmitted diseases are performed by, examination by a dermatovenerologist.

In general, a preventive medical examination can be carried out in any health care facility that has an appropriate license.

In any case, the administration of the DOC will tell you in detail what tests you will need to pass and what conclusions to enter in the medical book.

· Insurance certificate of compulsory pension insurance.

The insurance certificate of compulsory pension insurance (green plastic card) is a document confirming the registration of a citizen in the compulsory pension insurance system. RIGHTS AND OBLIGATIONS OF CHILDREN

At the international and national level, there are many special acts on the rights of the child. The main instrument on the rights of the child at the international level is Convention on the rights of the child (New York, November 20, 1989) is a 54-article child rights document. · Independent walking outside the territory without the accompaniment of a teacher;

RIGHTS AND OBLIGATIONS OF THE DRIVER

Based on the Model States, it follows that the job responsibilities of the counselor and educator are very close. In the procedure for changing specialized camps, camps with a day stay, camps for labor and rest (annex to the order of the Ministry of Education of Russia No. 2688 dated July 13, 2001), in general, the position of "counselor" is mentioned only in brackets: p. 3.4. Responsibilities of the counselor.

The counselor is personally responsible for the organization, life and health of children. In case of unforeseen circumstances, he immediately informs the nearest police station and informs the head of the DOC.

The detachment leader must perform the following functions:

· Ensure that children comply with sanitary and hygienic standards, monitor their observance of a neat appearance, cleanliness of clothes, the established order in sleeping rooms, other premises of residential buildings, a dining room and on the territory of the camp.

· Ensure the strict observance of discipline and order by children in accordance with the established regime.

· Organize the obligatory participation of the detachment in all camp-wide cultural, sports and health-improving and labor events.

· Organize the watch of children in residential buildings, canteen, on the territory of the camp assigned to the detachment.

· Monitor the cleanliness and order in the rooms. Organize wet cleaning of premises.

· Draw up, in accordance with the camp-wide, detachment plan of work, coordinate it with the senior counselor and report on its implementation.

· Participate in the organization and conduct of general camp activities in accordance with the instructions of the senior counselor and the head of the camp.

The responsibility of the counselor.

Detachment counselor:

· Bears full legal responsibility for the life and health of children;

· Bears material responsibility for the safety of furniture, premises and equipment of residential buildings, as well as other camp facilities visited by children, transferred to the detachment of bed linen, game, sports and other equipment for use.

During the work of circles, sports sections, hobby clubs, responsibility for the life, health and safety of children rests with event managers and other responsible persons.

The counselor is prohibited from:

· Miss planning meetings or other meetings of pedagogical workers established by the order of the administration of the pedagogical center without a valid reason;

· Leave the children of the detachment unattended, including at night;

· Leave the camp territory alone or with children without permission from the administration of the preschool center;

· Allow the presence of unauthorized persons on the territory of the camp without the permission of the administration of the DOC;

· Consume alcoholic beverages and be drunk on the territory of the preschool center, smoke in the presence of children, and also allow children to drink alcohol and smoke;

· Apply to children methods of influence that do not comply with the current legislation of the Russian Federation, international conventions on the rights of the child, the norms of pedagogical ethics (including physical punishment, punishments that humiliate the honor and dignity of the child, etc.).

By order of the administration of the preschool educational center, duties and prohibitions may be introduced for the teaching staff that are not provided for by this instruction, if they do not contradict the current legislation of the Russian Federation.
