IV. Vacation benefits

34. Additional annual leave is granted:

a) in the regions of the Far North - 18 working days;

b) in areas equated to the regions of the Far North - for a duration of 12 working days.

35. The total duration of vacation is determined by summing up the annual basic and all additional vacations (including for multi-shift work), regardless of its duration.

Employees who have the right to an annual basic vacation of more than 15 working days and at the same time to additional leave for work with harmful working conditions, when summing up these holidays, their duration should not exceed: 24 working days with 12 days of leave for work with harmful working conditions; 30 working days with 18-day leave for work with harmful working conditions and 36 working days with 24-day leave for work with harmful working conditions. If, with the indicated summation, the duration of these holidays is less than the annual basic holiday, then the annual basic holiday is granted.

For the disabled-blind, additional leave for work with harmful working conditions is added to their annual basic leave.

For workers of industrial and production personnel employed at enterprises, in associations, organizations of the coal, shale and mining industries, in construction and installation works in mine construction, in the operation of technological rail and road transport (in the technological chain) in cuts and quarries, in mining rescue units, metallurgical and electric power industries; in underground and open-pit mining, on the surface of mines, reserves, quarries and mines, in the transportation and processing of minerals, as well as for workers employed in the construction of subways, tunnels and other underground structures, the maximum duration of vacation, taking into account additional vacations for underground, harmful and difficult working conditions and for multi-shift work should not exceed 66-67 calendar days (57 working days) in underground work, and 52-53 calendar days (45 working days) in open-pit mining, excluding holidays established by the laws of the RSFSR non-working days.

36. Additional leave for the first year of work is granted after eleven months of continuous work in the regions of the Far North and in areas equivalent to them at a given enterprise, institution, organization. The specified additional leave before the expiration of eleven months of continuous work at the request of the employee is granted: to women - before maternity leave or immediately after it; workers and employees under eighteen years of age; military personnel transferred to the reserve and sent to work in the order of organized recruitment - after three months of work, as well as employees released from enterprises, organizations and institutions located in these areas with continuous experience giving the right to benefits - regardless from the time of work in a new place.

In the event of the dismissal of a worker or employee who has not worked for eleven months, monetary compensation in return for additional leave for the first year of work is not paid.

Workers and employees who are transferred from one enterprise to another, additional leave may be granted after eleven months of work before and after the transfer in total.

School teachers and teaching staff of higher and secondary specialized and other educational institutions, if they joined the given school or educational institution at the beginning of the academic year and worked for a full academic year, are granted additional leave during the summer holidays simultaneously with the annual main leave.

37. For persons working in the regions of the Far North and in areas equated to them, as an exception, it is allowed to combine, at the request of the employee, both basic and additional holidays, but not more than three years.

In this regard, vacation schedules should provide for the provision of vacation to each employee at least once every three years.

When combining vacations for two or three working years, the total duration of the vacation granted in kind must not exceed six months, including the time required to travel to the place of use of the vacation and back. The unused part of the vacation (exceeding 6 months) is added to the next vacation.

38. The time required to travel to the place of use of the vacation and back once every two years is not counted by the employee in the vacation period and is determined by the type of transport that the employee used. Salary during this time is not saved. The specified time is included in the length of service, giving the right to leave and receive benefits.

39. In regions of the Far North and in areas equivalent to regions of the Far North, workers are paid the cost of travel to and from their place of rest once every two years (and non-working pensioners once every three years). Enterprises, institutions and organizations located in these areas are allowed to pay the cost of travel to the place of use of the vacation and back once every two years, along with the payment for the travel of the employee himself, two members of his family (spouse, children). Payment for the travel of employees and members of their families is made by the relevant enterprises, organizations and institutions, depending on the actual use of travel by modes of transport.

Payment for travel to and from vacation is made before leaving for vacation, based on the approximate cost of travel. The final payment is made upon return from vacation on the basis of the submitted tickets or other supporting documents.

If travel tickets are not provided, but if there are documents confirming the vacation in another area, payment for travel to the place of use of the vacation and back is made at the lowest fare by the shortest route. Travel expenses on vacation and back by private car are also reimbursed.

If an employee spends his vacation time in several places of rest, then he shall be compensated for travel expenses only to one place chosen by him, as well as expenses for return travel from the same place by the shortest route.

40. The benefits referred to in paragraphs 38 and 39 are provided starting from the second year of work (ie after 12 months of continuous work). In the future, the employee acquires the right to benefits, starting from the fourth, sixth, etc. year of work, regardless of the time of actual use of the vacation. The time of continuous operation is determined in the manner prescribed by this Instruction.

The right to pay for travel to and from the place of rest comes to the employee after February 4, 1991, if the time of his continuous work before and after February 4, 1991 is at least 12 months in total.

The right to pay a fare once every three years for non-working pensioners begins in the third year after February 4, 1991, i.e. after February 4, 1993.

The right to pay the fare to the place of use of the vacation and back, along with the payment for the travel of the employee himself, two members of his family (spouse, children) comes from enterprises, organizations, institutions after June 6, 1991 (in the event that the employee worked continuously before and after February 4, 1991 for a total of at least 12 months).

A woman who is entitled to benefits can use them when leaving in connection with maternity and parental leave.

41. Upon dismissal of an employee who did not use leave, at his request, leave is granted in kind with subsequent dismissal, with the exception of cases of dismissal for guilty actions, which, in accordance with the law, were the basis for termination of the employment contract.

Leave with subsequent dismissal due to the expiration of the employment contract is granted when the actual hours worked and the time of vacation total the contract period or go beyond the contract period. In the latter case, the validity of the employment contract is extended until the end of the vacation.

When granting leave with subsequent dismissal, settlement with the employee and the issuance of a work book is carried out before going on vacation. The day of dismissal is considered the last day of vacation.

V. Benefits in the event of temporary disability

42. In the event of temporary incapacity for work, except in cases of industrial injury or occupational disease, the enterprise shall pay the difference between the actual earnings of the worker or employee and the amount of the state insurance benefit.

43. During the period of stay of a temporarily disabled worker or employee outside the regions of the Far North or areas equated to them, the additional payment for the allowance is not made, except in cases where the workers or employees leave for treatment at the direction of medical institutions on the basis of the rules established by the Ministry of Health THE USSR. At the same time, a referral to tuberculosis sanatoriums is considered as a referral for treatment in inpatient medical institutions.

VI. Pension due to work in the Far North

44. Pension in connection with work in the Far North is established: for men - upon reaching 55 years of age and for women - upon reaching 50 years of age, if they have worked for at least 15 calendar years in the regions of the Far North or at least 20 calendar years in areas equated to districts Far North, and have a total work experience of at least 25 and 20 years, respectively.

Citizens who worked both in the regions of the Far North, and in areas equated to regions of the Far North, a pension is established for 15 calendar years of work in the Far North. At the same time, each calendar year of work in areas equivalent to the regions of the Far North is considered nine months of work in the regions of the Far North.

Citizens who have worked in the regions of the Far North for at least 7 years and 6 months are granted a pension with a decrease in the age provided for in Article 10 of the Law on Pensions in the RSFSR by four months for each full calendar year of work in these regions. When working in localities equated to regions of the Far North, as well as in these localities and regions of the Far North, the rule established by part two of this clause is applied.

The labor activity specified in Article 12 of the Law of the RSFSR "On State Pensions in the RSFSR" is equated to work in the Far North.

The list of regions of the Far North and areas equivalent to regions of the Far North is approved by the Council of Ministers of the RSFSR. In the regions of the Far North and areas equated to regions of the Far North, when calculating the length of service, for the appointment of a pension, it is calculated at one and a half times.

VII. Housing Benefits

45. For the entire period of validity of an employment contract concluded for a certain period (three or two years), a living space is reserved for the employee at the place of previous residence, regardless of whether members of the employee's family stay there or leave with him. In the latter case, the living space is also reserved for the departed family members.

A security certificate (armor) for living space is issued by the executive committee of the local Council of People's Deputies.

Upon renegotiation or extension of an employment contract, a certificate of protection (booking) is issued for a new term.

The persons listed in the second paragraph of clause 3 of this Instruction have the right to book a living space without concluding employment contracts for a certain period.

46. ​​For workers and employees who have worked in the regions of the Far North and in areas equated to them for at least 15 years, housing construction cooperatives are organized for the construction of residential buildings in cities and workers' settlements of other republics, territories and regions, except for the administrative centers of the Union republics, Moscow and Leningrad, the Moscow region, as well as resort areas.

3. In cases not specified in this employment contract, the parties

are guided by labor legislation and, in particular, the current

The rules on labor protection in the production of road construction and repair and construction works establish state regulatory labor protection requirements for the organization and implementation of the main processes and work related to the construction, reconstruction, repair and maintenance of roads in good condition, operation used for these purposes road and construction machinery and technological equipment, as well as processes and work carried out at production facilities that ensure road construction and repair and construction work.

The requirements of the rules on labor protection in the production of road construction and repair and construction works are mandatory for employers - legal entities, regardless of their organizational and legal forms and individuals (with the exception of employers - individuals who are not individual entrepreneurs), when organizing and implementing them road works.

Responsibility for compliance with the rules on labor protection in the production of road construction and repair and construction works rests with the employer.
